that leaves an opening at the top of the atf, a very controversial position. the rumored head is andrew traver. he's been opposed by the nra because they see him as an opponent to gun rights. emery hurley. he was in charge of the day-to-day operations of fast and furious, he has been reassigned to phoenix. three of the four whistle blowers in group 7 have been reassigned, two to florida, one to south carolina. those whistle blowers could not be fired because that would be seen as retaliation. as far as the kput euf staff, however, they are being moved, if you will, ahead of expected to be a very critical report from the inspector general. also, multiple sources in arizona as well as washington say that the u.s. attorney for arizona, dennis burke, was interviewed by congressional investigators recently and he got sick in the middle of that and was not able to finish his testimony, that coming from multiple source necessar sources in arizona. we have received documents dated in 200 the showing 11 seizures of guns in the first three months of this program proving

attorney and atf. they are not giving names or dates anyone in who knew about it or approved the program. they are saying we allowed these gun smuggling crews to buy these guns and we continue to operate. then however in classic double speak the d.o.j. says, quote, to alloy the transfer of firearms to continue should not be construed to suggest the atf condones or sanctions the suspected firearms trafficking activity. that is highly ironic considering that, exactly what they did though they are trying to split hairs saying they didn't aproifts. yes, they did, and the document says they did. in terms of those 11 violent crimes in the u.s., the details are known. the department of justice admitted congressional investigators they know where these are, they just have not turned over that information yet. we are waiting on that because it could be potentially very embarrassing. you can have victims with claims possibly against the government for wrongful deaths. megyn: something is growing. but critics say

here's the new news today which is three of the key supervisors of fast and furious with the atf, thetobacco and firearms agencies, these three on your screen right now have been promoted at a time when there's a huge focus right now on this whole program, they apparently have been given new management positions in the agency's headquarters in washington, d.c. so no doubt, this is going to add another layer of suspicion to the whole situation in the investigation. why would these people be getting promotions when they're under investigation? >> well, i don't know. well, a lot of people don't know how high this program went up because it's such a disaster to give guns to criminals but senator says this. it is inconceivable to reward those who spearheaded this disasterous operation and with cushy desk jobs in washington. and i'm just wondering, is that what you do to people who you don't want to talk? who don't want to stay -- >> they already did talk. one of them testified to a house committee just three weeks ago, here was the quote. i share responsibility for mistakes that were made.

when you have the outgoing acting director at atf comment that the justice department is doing things the political appointees within the department of justice i have serious questions about that. bill: you think nelson was the fall guy? >> he has been very cooperative with the committee. there was some indication that documents were purposely being withheld from congress. those are serious allegations. so something we'll continue to dive into and thankful to the whistleblowers. bill: when congress comes back next week do you expect more information from other whistleblowers who have not come forward? does the committee continue its investigation? what is next in this? >> there are still a series of investigations that we have to have in terms of interviewing people and what did they know and tying these documents together. we are finding that other agencies are probably more involved in this than we initially thought from the fbi and others and homeland security. we are trying to tie owl of that together. but when we are asking for documents and they are coming back with literally th
