let's bring in jim kavanaugh who is a former special agent in charge of the atf. atf is on the way. what do they plan to do in this sort of situation. >> at the el paso pd and the sheriff's office, of course, the fbi and the texas department of public safety, the texas rangers, they'll have a big investigative team. of course, initially if they need assistance in take advantage t-- containing the ara or whatever they can do. they have the full range of law enforcement services, just like all agencies that respond to these do. i'd say now it's slowed down. kendis, when the public information came out and reported one in custody, and no active shooter that they knew of, it seemed to me they know they've damped this down pretty good and they're doing their security sweeps of the other reports. i'm not sure they have a lot of confidence in those reports of other shooters, but they're doing the security sweeps there. it may be they do have the shooter in custody. let's hope that's true. well. they do say they have at least one suspect in custody. we have had some conflicting information

i've been in a couple shoot-outs and they're wild as a uniformed officer and as an atf agent. they're wild and chaotic. there's fog of war hanging in the air. you're getting information from your commanders, your dispatch, this is america's patrol officers. the beat officers showing up in a patrol car that arrested this guy. so they're there. in four or five minutes as the chief said. so they're responding to a 911 dispatch of shots fired at or near the this rifle is very loud. they'll hear the reports when they roll into the parking lot. they'll hear it if he's still shooting. he surrendered to them and he was not injured or hurt or shot. we know that from what the chief told us. so it is very chaotic. then they have to get all the emergen emergency. we just heard from the chief and the governor. 20 dead and 26 wounded. that's 46 people of the he had a lot of ammo with him. if it verified, it looked like he had his cargo shorts packed with heavy items. probably magazines. he had the rifle, probably the shooter's glasses had hearing protection. the authorities can't say, you w

president mentioned that he has been working with, not only with the federal agencies including the atf and the fbi, offering those resources to texas, we also have herald from the attorney general, bill barr. he put out a statement in the last 90 minutes or so, he said, quote: the justice department joins in mourning with the people of el paso. those who commit such atrocities should be held accountable swiftly and to fullest extent of the law allowed. we've been hearing from a number of federal initials including the two -- officials including the two republican senators from texas, offering condolences and offering resources that they can provide as well. as we talked about, you heard from beto o'rourke as well as joe biden. many of the 2020 candidates weighing in, jon, we're continuing to monitor and see if we have more reaction tonight. jon: mark meredith who's traveling with the president, thank you. so it was a horrific day in el ifs paso, texas, when a gunman opened fire in a shopping center parking lot, then went into a walmart and continued to do the same and then into a mall.

the atf agents, as you can see, just moments ago arriving on scene. they will be giving the assistance to the dayton police department as well as other federal agencies who will be en route. we believe that at least 16 people were injured there. and moments ago, a local hospital told msnbc that one of those injured remains in critical condition. no one has gone to surgery, but that could actually change. the injuries were mostly from gunshots. police say the suspect was using a long gun and that he was killed by police officers. no officers were injured. officials are now trying to identify the suspect. dayton police with this update. >> we had multiple officers in the immediate vicinity when this incident started, so there is a very short timeline of violence. for that, we're very fortunate. this was all an exterior event. it all occurred outside. >> any description of the shooter you can share? >> not yet. the shooter is deceased, and we're still interviewing, obviously, a lot of witnesses, as well as officers, to try to determine if anybody else wa

we turn on our breaking coverage to former atf special agent in charge jim kavanaugh. jim, what can you glean from the initial reports that we have? >> well, s.w.a.t. is already on the scene. they've got that place surrounded and know where the shooter or shooters are. so they're getting the civilians out of the nearby hows. you can see that on the news photographs. officers is initially were down behind their vehicles. you could hear on the radio from the philadelphia pd radio they were calling tore long guns asap. patrolling into a hornet's nest there. five officers shot. they got this barricaded one or more in the house. so what the on scene s.w.a.t. commander has to determine is how many shooters are in there and how many innocents could be in there. this could all be settled by one s.w.a.t. long rifle man if the shooter comes to the window. once s.w.a.t. is in position. they're going to lock it down if they can stop the shooting from inside, they'll try to negotiate, but if the shooting continues look for it to be solved by police gunfire. >> we're looking at some

jim of the atf.an interesting evolution in the conversation, to have the texas land commissioner and rod rosenstein, saying what you have been saying for some time. there's something that matters, getting the public to understand. the danger of white nationalist domestic terrorism is the greatest threat most people face right now. clint? >> that's right. this issue going to the election. president trump supporters were hot on militant extremism. they need to call it what it is. it is clear that we have a white nationalism problem in this country. we've seen repeated attacks. we're seeing attacks inspiring each other. this is a similar pattern. if we don't call it what it is, if we don't put the pieces together, we don't demonstrate that the attacks are related, we're hindering the federal, state and local law enforcement's ability to preempt the next attack. we need to network against them just like other terrorist groups. we built these task forces after 9/11. and we got better. over the last decade

the fbi and atf are on the ground in el paso. the president has tweeted out saying governor abbott of texas will give full federal help in anything they need to again and complete this investigation. the governor said not only is it a capital murder vest issue but also a hate crime investigation with that we bring in maureen o'connell part of their evidence response team. maureen it's noteworthy that the governor said 10 hours after the first shots ring out, almost 11 hours that the bodies of the deceased are inside that walmart it's so long and so larger process and crime scene to get through. >> part of that has to do with the trajectory of the rounds that were fired in the bodies have to remain in place and tell they can get those details details down in a way that can be used in a court of law. the evidence will have to be packaged properly. they are going to have to measure the way the victims fell and try to figure out exactly where he was standing when he fired all of those rounds. it's a very laborious task but a very imp

you are seeing a lot of heavily armed polnd law enforcement, fbi agents, atf all entering caution.ail it is teally it is the. seems like police and officials there have an idea about how many people have been hurt and killed here, but they are not ready to release it. i think that they are still going through the scene. you can only imagine what the scene must look like from just the shear panic, people running. and there are bodies quite frankly in some of these areas. so as the police said and what we have been hearing is that the official reports to police was that the shooter went from the walma walmart, i don't know the distance between the walmart and mall, and then he walked to the mall, went into the mall and that is where also thoughts were fired. so people injured inside that mall. so police are still trying to get a handle on exactly how many victims they have. and the suspect who they say is in custody, we don't know his condition is. and if he is alive, that will give them a lot of clues and significant details on exactly why this happened and what the motivation here

i want tog to jim cavanaugh formerly of the atf. you and i have covered instances that may not be domestic terrorism, that might just be shooting. but there's a flavor to some of these things. we have a gun violence problem in this country. that's well established. and every instance of gun violence is not domestic terrorism or born of white nationalism, but we're starting to see closer interactions between these two things. if you happen to be a white nationalist and intent on terrorism in this country, it's relatively easy to do because of your access to high-powered weaponry that can inflict a lot of damage. >> historically, this is true. i go back 40 years working on these neo-nazi and klansmen and they were saying the same stuff. my death is going to start the revolution that's going to make an all-white homeland. if you read these screeds back in the '70s, right in the post-60s civil rights era, it's the same stuff. i mean, we were immersed and they wanted guns and bombs and machine guns. and that's why aff and fbi and the pol

>> the fbi is there, the atf and now at this point right now the locals are managing all of this and the local police and the el paso police and there is a chance the fbi is there that they can come in and take the lead on this investigation and so that would significantly ramp up the entire investigation and certainly it would ramp up, there could be some cause for the fbi -- >> what would the cause be for the fbi to take over responsibility? >> any kind of terrorism with links to overseas terrorism, right? not necessarily domestic terrorism, but the other thing here is any kind of hate crime. was this some kind of hate crime and then the fbi would certainly, in consultation with the department of justice, they would come in and take the lead on something like this. right now we've seen fbi agents as you see on the screen and those are fbi agents from essentially the response team that they go in and they were helping, and searching through the building and through the mall, through the walmart trying to find victims. perhaps to see if there were any other shooters involved and as w

executive action and also in the form of legislation, one of them is to put more resources into the atf to take the licenses of gun dealers who violate the law. and that includes a number of things, including when they are responsible for doing background checks, not doing them. >> so but does your plan go from your perspective far enough? >> well, there are a variety of things. let's be clear, i have -- i have hugged too many mothers of homicide victims over the years. i have looked at more autopsy photographs than i care to tell you. of people whose lives have been ended because of gun violence. we need congress to act. we do not lack for good ideas. we do not lack for tragedies. the failure of congress, however, the united states congress to act on passing smart gun safety laws is the issue. so when elected, i'll give the united states congress -- 100 days to pull their act together for my signature and then i will put inback and resources to the atf and take away the gun licenses -- >> and just to be precise -- you want to give congress 100 days and then take executive action. some
