athena jones is "outfront" live in baltimore. athena she's talking about the state of maryland but the rules in baltimore city are different for knives. what are you learning about this crucial question? >> what we're learning is that there's a lot of disagreement over whether the knife freddie gray was carrying was legal or not. there are also people questioning whether maybe the knife was legal in the state of batltimore -- or the maryland but not legal in the city of baltimore. motions that have now been file the by two attorneys for two of the police officers in this case, those motions don't mention city code city code in baltimore. they both say "gray's knife was not lawful under maryland law." of course we haven't seen the knife. why does all of this matter? it matters because it goes to determining whether it was legal to arrest freddy x-ray in the first place. was freddie gray's arrest illegal? it's a crucial part of the argument made by prosecutor marilyn mosby in charging six baltimore police officers in in his death.

athena jones is watching this go down on capitol hill. athena we check in again.king. can you tell me what he's talking about, why he's doing this? >> well, he's been speaking now for more than two hours. he took to the floor at 1:18 p.m. his office says he will speak until he can no longer speak. if he speaks all night he will still have to give up the floor tomorrow by 1:00 p.m. because of senate rules. that's when the next day convenes at 12:00. but the bottom line is whether or not you call it a filibuster, he does a lot of people saying it isn't technically a filibuster because and he is not actually blocking a vote on the nsa bill that he opposes. right now the senate is debating trade. but he's taken to the floor to make clear his opposition to any extension of this session of the patriot act that allows national security agency to have access to americans' phone record bulk collections of phone records. he wants to see big reforms to that law. so he is on the floor now. his office says he will speak until he can no longer stand. he's also of course trying

i do want to begin with cnn's i i -- athena jones. it looks like they have the votes for what both sides are calling a compromise. the usa freedom act. what does that do? >> that's the bill that passed the house with overwhelming bipartisan support. 338 votes to 88. what it does it takes the holding of the data the phone data that's being collected, takes it out of the hands of the government out of the hands of the national security agency and leaves it with the telephone companies themselves. the government then has to have a warrant to access that data. so that is one of the big changes that it makes. this is for people who wanted to see the patriot act provision reformed. but that bill failed to pass here in the senate just a week ago. just fell three votes short. now it's looking like it's going to have the votes it needs, the 60 votes it needs, when they have a series of votes later this hour we expect them to come back later this hour and pass votes that will allow them to begin debate on that bill. some folks have changed thei

that's where athena jones joins us.ot the doj laumplingnching an investigation, this is a review. >> reporter: that's exactly right, it's not a full-scale civil rights investigation, it's a review. we know the statement from the civil rights division of the department of justice, also from the special agent in charge of the cleveland fbi and the u.s. attorney for the northern district in ohio they have been monitoring this case monitoring the investigation since the events occurred back in november of 2012 and so they are going to be continuing their assessment reviewing the testimony and the evidence presented in the state trial. they'll be reviewing all available legal options and will collaboratively determine what, if any steps are available and appropriate given the requirements and limitations of federal law. i should point out even if there were to be a full-scale investigation, there's a very very high bar from bringing federal charges in these cases. you didn't see federal charges in ferguson missouri in the mi

we heard from athena.ady completed a two-year investigation looking into the practices of cleveland police. and now they will be looking into the testimony, the real path of this verdict today. how unusual is that or is that expected given that they had already investigated cleveland police? >> you know fredricka, this will be the new normal just based on the climate throughout the country concerning police activities and citizens. and really to restore some sense of public trust so that the public knows that law enforcement is really looking at these matters with a fine tooth comb. understand as you mention, the prior investigation from the civil rights division was based upon the pattern and practices of the department itself. this will be specific as to brelo's conduct and make no mistake about it what the standard is is very high. you would have to show in any civil rights prosecution, should that be the case after the investigation, fredricka, that there was an intentional deprivation of a civil right
