it happened at the atria park care facility in san mateo. nbc bay area's marianne favro joins us with the latest on this investigation. >> reporter: i just spoke with the daughter of the resident that died. she told me her mother was 94 years old, and she had lived here at atria park since 2020. right now, san mateo police detectives are inside the facility conducting interviews. while police are not commenting, sources with direct knowledge of the investigation tell us san mateo fire crews were called to the facility on saturday and transported two residents to peninsula hospital in burlingame. one woman later died. another resident is in critical condition, and a third was taken to a different hospital. atria is a large facility described online as having 135 various apartments spread across three floors. a source close to the investigation says this may be a case where someone thought they were pouring some kind of juice for the residents, but instead ended up giving some of the residents some kind of poisonous liquid to all three. now, w

looking at more state complaints involving this one facility and i found this wasn't the first time atria has done this. in 2019 a resident suffered from multiple falls, a head injury and pubic fracture. then i found two other substantiated complaints from last year of staff not providing op proper care. in those cases the stayed -- >> so a lot of things you found here. is this fairly common or are these small things or notable things, these discrepancies? >> the first about the falls and head fracture, that is serious. but, yes, you're right. a lot of these care facilities are getting complaints staffing in general. >> this facility in santa monica are they understaffed? >> it gets complicated there. it's important to point out that it is an assisted-living facility, not a nursing home. nursing homes have those strict nurse to patient ratio rules. assisted living facilities don't have those rules. i wanted to bring up the rule from the state and it's this. sufficient staff must be employed to deliver services required by residents. now, raj, there is no formula there. there is no spisk.
