attorneys are battling over a wrongful death lawsuit filed by the family of saratoga high school student audrey pott. lawyers for two teenagers who sexually assaulted pott and shared photos of her want the trial moved out of san jose. her parents blame that attack for her suicide a short time later. defense attorneys are also asking that the courtroom be closed to the public. the judge did not rule on today's requests. the trial is set to begin on monday. >>> meantime new details in what led up to the murder-suicide at a palo alto senior living facility earlier this month. police believe a resident 69-year-old mark miller shot and killed the complex manager, 70-year-old vincent collins because miller thought collin was stealing from him. miller then killed himself. six weeks earlier police say miller called them because he thought collins was taking things from his apartment when he wasn't home. an officer determined that was not the case. >>> a fourth man charged in the shooting death of an oakland mother admits to giving an assault rifle to one of the gunmen. 21-year-old michael stills was in

. >> reporter: the wrongful death trial of audrey pot is set to start in his san jose. pot committed suicide in 2012 after she was sexually assaulted by three teenage boys while she was drunk and unconscious. photos of the assault were posted of social media. one of the boys and his family recently settled for six and a thousand dollars and will not face trial. lawyers for the other boys favor suicide was prompted by other factors there were not related to the assault. >> reporter: the newark police department is warning residents that fake check scams are becoming more popular in one scams' someone called laurie mills victims offering a job and thousands of dollars in paychecks up front. the victims are told to activate their employment by depositing the checks. then they're asked to buy green got money pack cards at different locations and be a mystery shopper where they evaluate the retailer. after that they e-mail the evaluation and clothes from the prepaid card. by the time a bank realizes the she paychecks were fake the stammers have cashed in on the green dye car
