john avalon, let me start with you. miguel's in colorado, crucial state.is group of latinos can decide the state. where else will they swing at? >> this shows where the latino population is throughout the united states. strong throughout the southwest but growing enormously. let's take a look at three other swing states in addition to colorado that could determine the winner of this election. first, nevada, where mitt romney is tonight. we've got more than a quarter of the population now latino. when barack obama won this population by 3/4 in 2008. and you'll see these in all three states, they elected a republican governor. brian sandoval in 2010. it shows just what a swing state this is and how pivotal it can be. let's look at the next one. new mexico. one of the big bellwethers. also elected hispanic republican governor in 2010. this dynamic again showing one of the real states up for grabs. and finally probably the big kahuna, florida. florida, florida, florida. the infamous swing state. 2010 they elected marco rubio. you see the population diverse. bu

john avalon joins me now, cnn political contributor, mara hoover is here with us in the studio.o happens to be the the better part of john. more of her biography on the left side of the screen. great to have o all of you with us. john, let me start with you. the president when he was a state senator supported gay marriage. then he got in office and realized, politically, maybe you've got to be more careful. but joe biden has put him in his spot. is the president now going to be forced to say, yes or no, not on something ambiguous, but on gay marriage itself? >> well, i think, certainly, there's pressure building on the president among the the democratic base. and what joe biden and the cabinet secretary said, i think, reflects the growing conventional wisdom within the democratic base. the problem that the president has, of course, is elections are won with swing voter ifs swing states like north carolina. and while this president can point to successes in advancing gay and civil rights much more than any other president, that final step would lead him open to a series of negati

john avalon and paul cowen are with us tonight. paul, let me start with you as an attorney. i've talked to a lot of s.e.c. attorneys today. i've talked to the s.e.c. about some of these very specific allegations. do you think this case has merit? basically it's saying facebook, they changed this. it was a material thing to say look, we can't make money in mobile and it's future. we haven't yet. they amended it. that was given to everybody. but then, morgan stanley and the banks said look, this is really going to hurt how much this company can earn and not everybody who was buying the ipo was made aware of that. fraud? >> well, it's a close question. if you believe every allegation and the complaint, yes, it does make out a claim of fraud. but i think we have to step back a little bit and say also that every time there's a public offering on a company like this, the class action lawyers swarm around it and file lawsuits because the legal fees that are collected in a case like this are staggering. multi-multi-millions of dollars in fees for the lawyers, so there's not a lot of

would mount a serious third party candidate for president and i want to play a piece of tape of john avalon. this is you back in december. >> this is going to happen. this is going to be a major player in the 2012 election. you know, you're going to have a centrist bipartisan ticket. on the ballot in all 50 states. fwloo so that didn't happen. americans-elect, no major candidate. wanted to do it. were you overly optimistic? >> well, certainly. this effort did fail. they succeeded on getting on the ballot in 26 states. meant getting over two million people to sign up and i think there remains a desire. you have a record number of americans, self-identifying as i wanted pent, 48% say they want a third party ticket. the fact that they couldn't recruit a credible candidate. romney and obama represent, i think, the center right and center left respectively of their parties. the other factor that was significant, technologically they were so focused on ballot security that it was enormously difficult for people functionally to support a candidate, but this is a real disappointment and a real fail
