avery freedman in cleveland, ohio. and richard hermann, new york criminal defense lawyer joining us from las vegas. richard, the supreme court has choices of cases it could take here. it decided to take these two, doma and proposition 8. why do you think they took these and not others? >> you know, after this election, this issue is so ripe for the supreme court the jurisdictions are so split in their laws, many states recognizing same-sex marriage and performing same-sex marriages. some states not recognizing them. this is the perfect scenario for the supreme court to step in and ultimately make a ruling. there are over 1,000 cases, joe, in which federal laws are impacted by marital status. the time has come. it's ripe. prop 8 was on the doorstep for the supreme court. here we go. >> avery, we were trading e-mails a little bit a while ago. one of the questions i asked you was whether the supreme court essentially gave itself an emergency escape hatch with one of the cases it chose. can you talk about that? >> late yes

but let me ask you, avery then.ou know, somebody who is bringing the suit, they are s e recei heavy duty. one pilot was forced into the ground training when the helicopter was shot down. she had to rescue others. what kind of case do you think -- what can leon pa net why argue basically? >> i don't think i can construct a sensible argument. i don't know that leon panetta is unsympathetic. i think this case belongs in the federal district court. it's a 19 page complaint and is based on the fifth amendment. a lot of people think that women was prohibited. it wasn't until the 1990s, believe it or not, that the arms forces made it a policy. the jury prohibition exclusion. so the bottom line on this thing is that these indeed are war heroes. they have taken bullets. they put their lives. they're decorated. this is a case that i think is going to result in getting rid of gender discrimination in the military. it's about time. and these war heroes are exactly the people that should be prosecuting this case. >> absolutely.

give me a break. >> avery, he has a point there, avery. we all have these things these days.verybody has badges with microchips. we're all tracked. does this young woman have a leg to stand on? >> yeah. let me explain the constitutional issue. the argument is that it's free exercise of religion under the first amendment nap's the argument. the fact is the school has accommodated her faith by yanking the chip. she's got the i.d. the federal district judge in san antonio did a great job, miguel. he asked this wonderful young woman, 15 years old, look, now that the chip is out, are you okay? she said no, i don't even want to use the i.d. nothing in the first amendment permits miss hernandez to avoid the i.d. ultimately judge garcia, who's the federal judge here, will rule against her, judgment for the school district. this case is dismissed. >> guys, thank you very much. we'll be back in about 20 minutes to talk about a legal setback in the penn state case, the university trying to delay a lawsuit brought on by a former assistant coach. >>> a growing problem in chicago, street v

avery, i'll begin with you.u think he might have a point that this was such a heinous crime to be charged with that people did not focus on fact? >> well, i think jerry sandusky is no less unrepentant and delusional as he was for actually going on 15 years at this point. look, there may be errors that will be identified in the court of appeals, marty, but the question is are the errors harmless or are they prejudicial to the extent that that verdict's going to be reversed, not in a million years. the fact is the evidence was solid. one of the heroes, mike mccareery, on staff, was solid in his testimony. he reported it. the big missing link i think is in pennsylvania to strengthen the mandatory reporting law, so you don't go to the boss when you see something, you go to the cops. and i think that was a major part of what this case is. i think the court of appeals has no choice and should affirm those convictions. >> richard, same thing. what do you think of the process of appeal, here? >> marty, you know, when yo

morning, avery. >> good morning, carol. >> i think the thing that stands out for most people is thats grandmother who was 92 years old. apparently he beat her to death and he was on parole. he only served 17 years. how is that possible? >> yeah, it seems impossible to happen. but if you study this, spengler was in his late 20s when he committed this murder. and one would expect that he would have spent the rest of his life in the new york penal system. the fact is, though, that he was paroled out and actually had an obligation to report to his parole officer until this happened. but the fact is that it struck me as virtually impossible for the parole department not to know that this guy was a problem. the fact that he committed this murder -- again, even though he was in his 20s, unless he was a model person in the penitentiary, it would seem pretty obvious that there was a problem with this guy and of course the worst happened here. and we will never know, although we do tend to think that because of the hatred he had toward his sister, that was the motivation. and then set the buil

a avery, we're talking about two countries. two separate sets of laws.in something like this? >> well, the alleged crime of course occurred in aus trtralia but the fact is that the law that officials are looking at right now, ted, is the a law that deals with basically those people engaged in stalking. intentional harassment and coercion. it's not a law, in fact, this is a case, ted, that will never resolve in criminal charges. i think the tougher question is will there be civil liability arising out of the case. >> and what's the clanhances of that? did you say there's no criminal case here. i would think. from layman's term because these radio stations across the world do this on a daily base and nobody could have forseen the tragedy here, but civilly, what would it take for a successful civil suit? really, the facts of this are the same whether you're talking criminal or civil. there was no intent of this end happening, obviously, by these two individuals or the radio station. >> right. well, actually, you said the word, the civil liability. and that
