i'm philip babbage. i'm council for the appellants. the appellants have worked hard to get a small slice of san francisco. now that they have this, they want to make sure that they don't lose basic rights. i'm going to address the issue of noise. julie castaneda, ronald [inaudible] and tanaka banes will address the other issues. -- in response to our appeal, the planning department contends that the e.i.r. conservatively, "conservatively" analyzed the plan's construction noise impacts by assuming that residential noise sensitive receptors, the people, would be home during construction activities, including during normal business hours, i.e., 8:00 a.m. to 5:00 p.m. however, the e.i.r. did not expressly analyze construction noise in this manner. it relied on an initial study which merely pointed to the san francisco noise ordinance and possible mitigation measures for future projects to reduce construction noise. the initial study did not discuss construction noise any further. we cannot find support in the initial study for the planning
