the election commission and the bar associations. the committee's final report is expected to be made public on wednesday. remember, house republicans have promised that in this investigation of the select committee's work is also coming as soon as that party takes control in january. much in the january six committees evidence, including transcripts of witness interviews, will soon be going to the department of justice. bloomberg now reporting recent subpoenas from special counsel jack smith indicate that a new branch of will be in place for march of 2023. one of the key figures in trump's fight to overturn biden's 2021 is now facing a serious punishment for making false claims of election fraud. the committee for the d. c. bar today recommended former trump later, rudy giuliani, may be disbarred. the d. c. court of appeals will make the final decision on disciplining giuliani, coming up. with that, let's get smarter with the help of our lead on panels. baker joins us. chief white house correspondent for the white house. cheney, for

we're going to hear about referrals that may go out to state bar associations that there's a lawyer involvede going to learn all of that on the 19th, what the basis of these referrals are, what the names on that list are, and we may learn some other details in the public meeting. the committee is going to vote to adopt their report and then on the 21st that report is going to be made public. so we're seeing a little bit of staggering kind of trickle of the news. >> thank you, sara. >>> we're joined now by representative zoe lofgren. thank you for joining us. you know a lot better than i do, the committee will issue -- will use monday's hearing, we're told, to announce criminal referrals. cnn has reported in the past few days that under consideration for these criminal referrals were not only former president trump, but some associates, including mark meadows, john eastman, jeffrey clark and rudy giuliani. does that lineup, congresswoman, with what we can expect on monday? >> well, as you know, wolf, it's been my practice not to jump ahead of the committee and make the announcement. we're jus

not just against more people, but also different in nature, perhaps to bar associations for lawyers who were involved with unethic or illegal things that the committee things they have enough evidence on. but they've given us the blueprint over the course of these multiple hearings that we saw over the summer and into the fall and now we'll see them in summation today and releasing that final report on wednesday. >> we heard adam schiff say -- and just a little while ago in our last hour congressman pete agular said they believe there's evidence to support these charges. in your opinion, how hard would it be to prove them? >> well, there's a big difference between saying we believe there's evidence and actually being -- actually feeling like you have enough evidence to take a case to indictment and then to trial. so that is what the department of justice has to consider now. i think everybody recognizes that. but the really interesting thing here is that the really important thing to the doj is that the committee, the january 6th committee is now actually concluded its investigation and

categories of referrals that the committee could make, for example, to the ethics committee, to the bar association. and committee members are also going to be voting on its final report in order to release that report on wednesday of this week. >> okay. and then why does any of this matter? i mean, why is it necessary? >> so, taking a step back on criminal referrals, it's largely symbolic in nature. the department of justice already has wide-ranging criminal probes into january 6th. but if committee members stand up there on monday and make a statement that they believe that their evidence, over a year's long amount of work, over 1,000 interviews, over ten hearings, they believe all that evidence leads to and points to a crime against the former president, that's really a strong public statement for the committee to make, fredricka. >> indeed. annie grayer in washington, thanks so much. >>> and don't forget, of course you can join cnn's jake tapper and erin burnett for special live coverage starting monday at noon eastern time. >>> now to the u.s.-mexico border where cities are bracing for what's

we will let the bar association handled on their own.re lawyers also paid by individuals to represent clients who came before our committee. who basically had invested interest in those clients. not telling the truth so there were significant dollars raised by former president trump. that never went towards the efforts that for which people donated money. and so we do not know if this was an effort to just make money but we know that when people donate money to you to stop the steal. and none of that money can be traced to anything to stop the steal and you still have the money right now two years after there are some problems with that >> but they were not unanimous decisions. so rather than go down there, we looked at the broader issue. and to be honest with you, we wanted to look at recommendations. but it was just so agree just. that the committee felt in terms of what the former president had orchestrated that we just could not in good conscience make the referral. >> do you have confidence in the justice departments investigation i

and that could include referrals to the house ethics committee or to the bar association. and beyond that, we're going to see all of the members on the committee vote to release its final report which once that vote happens, will be released on wednesday of this week. >> so, no surprise the trump team has released a statement. it's calling the committee a kangaroo court that held, quote, show trials. how much does any of this matter? >> so, look, the department of justice is obviously going to take a look at whatever the committee sends their way. because the two sides haven't really been sharing information this whole time. doj wants to see what the committee has. some of these referrals that are under consideration won't be a surprise to prosecutors. a federal judge has previously said he also believes donald trump could potentially have obstructed an official proceeding. and let's also be honest. a criminal referral from the january 6th committee to the department of justice is largely symbolic in nature. doj already has wide-ranging criminal probes into january 6th. bu

but there could be referrals to state bar associations for the lawyers like giuliani and eastman, andhouse ethics committee for members of congress for violating the cold of conduct of the congress. >> so these referrals would largely be symbolic, right? i mean, the doj doesn't need the referrals in order to proceed. is it your view the doj already has similar evidence or perhaps even plucked some evidence from the committee's work that they are combining into their ongoing investigation? >> i think the latter. i think that doj, because it has subpoena power broader than the committee, probably has been able to gather evidence that the committee has not been able to get. they, as you know, had other white house lawyers into the grand jury and the house couldn't get them. and the house, though, has got an big head start on doj with its depositions. so i think the doj will hear these referrals as a serious act of -- view by the committee that there is criminal activity. they'll combine it with their grand jury evidence and make a final determindetermination. >> when committee chair thom

those could be a referrals to various bar associations to try to get them to spark. you mentioned congressional referrals, members of congress who were involved in this effort as well chair. german thompson asked spoken specifically about referring some of these gop lawmakers, people like scott perry and others, to the house ethics committee for possible ethics investigations. that is something that -- donald trump is obviously the main focus but we are likely to hear about some other broader attempt to overturn the election. >> i want to touch on what we heard from schumer. he showing a lot of optimism when it comes to the path of republicans going forward, not even cautious, just straight-up optimism, which i found pretty interesting to say the least. here's what he sent. i think there's going to be a whole chunk of republicans in the house and senate who realize that the maga way doesn't work. i hope to work with them to get real things done. i said this to mitch mcconnell. i think you can see for themselves that i don't have to do this. tell me more. >> well, of

that certain lawyers who were involved with these efforts maybe be disbarred from their state bar association, prevent them from practicing law going forward, along with potential referrals that are going to mirror what we've seen written by prominent federal judges like david carter, who have said that it is likely that john eastman, a lawyer for the former president, engaged in conspiracy to defraud the american people, and the obstruction of congress. we should also expect this committee to pick up on some of these cliffhangers that liz cheney left us with at the end of these hearings where she said there were certain people who were involved with potential witness tampering. so a lot of these looming questions that have been hanging over us since the somerset of hearings are going to be answered next week. >> jackie, certainly a lot to watch out for with the potential criminal referrals. this committee has not disappointed. nearly every meeting they've had, they've presented new evidence, surprises to captivate attention, but there's sort of been this unspoken mission if you will to short

they're autlining several steps that many different bodies whether it's congress, bar associations within different states or law enforcement agencies, the steps that they should take as a result of this comprehensive report from this committee. the biggest one that i'm seeing here is that this committee is recommending that there be steps taken to enforce the 14th amendment section 3. this committee says, of course, that part of the constitution says anyone that incites an insurrection should be barred from holding any future office. so specifically it says the committee believes that those who took an oath to protect and defend the constitution on january 6th should be barred, disqualified and barred from holding government office. and if you read between the lines there, of course, they are pointing directly at the former president trump who has already announced his candidacy for 2024. so that's a big step for this committee saying that, look, it's right there in the constitution. if you incite an insurrection, you are barred from holding future office. unclear if that would be actual

lawyers involved who are involved we're seeing this, they're getting sanctioned by the bar association able to be lawyers again because they played such a key role and they're working on trying to overhaul the electoral count act which is something congress has been working on for some time. the idea being that you can't just try to overturn elections by using members of congress to do that. >> and that is one thing that made it into the omnibus bill. evan perez, thank you so much. >>> joining me now to discuss, michael moore, a partner at moore paul in atlanta. good to have you back. >> good to see you, jim. >> the big questions here is did they establish evidence, did they find evidence that, particularly as a lawyer, would say okay there is a crime here. if you connect the dots, i mean 200 attempts to pressure state officials to overturn results, that it was premeditated, that they made plans for this and that trump himself was saying some of the fraud ideas were crazy, seems to get to the question of intent here, right. when you connect those dots, do you see a viable case? >> well

they could reverse some of the lawyers to their local bar associations. >> yeah. i think what's important about the january six committee is the facts that they've been able to uncover. certainly, they will make referrals, but it is not anything that the justice department doesn't already know in terms of whether the possibility exists that crimes were committed. i still think it has an important symbolic value to say that we do refer, we do believe that crimes were committed because i think that if you consider the alternative, if they were to not make a criminal deferral, i think that trump and his supporters would say, look, the committee did not even make a criminal referral, they didn't find any crimes. so it is one of those, you know, damned if you do, damne don't kind of situations and so i think that it is wise to follow the advice of janet reno who always said, i'm damned if i do, i'm damned if i don't, i may as well do the right thing. i think in this instance, a criminal referral probably seems appropriate. but another thing that's important andrea is i

lawyers like this give attorneys a bad name, and judges and bar associations take these allegations very seriously. lawyers are supposed to be officers of the court and trying to get a lawyer to -- trying to get a witness to lie in court is the opposite of the oath that ke take as members of the bar. so now we have this witness, cassidy hutchinson, as a fact witness to the crime to january 6th and now a fact witness also to a potential cover up. >> luke, let's talk about a batch of 34 witness transcripts. you dug through them and pointed out many of of the witnesses simply pleaded the fifth over and over again. we can show you some of them because john eastman pleaded the fifth more than 150 times. he another former trump lawyer. former national security adviser mike flynn pleading the fifth to virtually every question he was asked. and kelly ward even pleading the fifth when asked about her phone number ask where she went to college what does this tell us about cooperation? >> the committee is going to be releasing hundreds of transcripts over the next few days. this was the first batch
