attorney barbara mcquade wrote what she called a model prosecution mammal. minal charges against donald trump for pressuring mike pence to overturn the results of the 2020 election. in our memo, mcquade argued that it leads to federal criminal statutes may have been violated in this episode alone. conspiracy to defraud the united states and obstruction of an official proceeding. now, as you may be thinking right now as you listen to this. as we found out last night, those are the same arguments, almost verbatim, the lawyers of the january six committee just made in their latest court filing in california. they say they have a good faith basis for concluding that, quote, the president and members of his campaign engaged in a criminal conspiracy to defraud the united states. that donald trump obstructed, influenced, or impeded, or attempted to do that for an official proceeding the united states. turning now to the author of that memo, barbara mcquade, former attorney of the eastern state of michigan. co-host of the sisters and law podcast. and she joins me now

jennifer reuben is back with us, and also joining me, barbara mcquade, an embassy and law analyst andor at the michigan law school. barbara, i have to partner for you, first, could ginni thomas be in any legal trouble? and second, does the january six committee have a case to subpoena her? >> so, i think the answer is yes and yes. when you say, in any trouble. i don't know if she faces legal representations, not at this stage. but this really feels like an invitation to a subpoena, doesn't? it they want to find out everything that happened relating to the events of january six. issue was, there someone was putting a lot of pressure on the white house, mark meadows. i think that we want to see the rest of those documents and colors of witness. yes to the subpoena, and not only for her to come and testify, but i want to see the rest of those messages. part of the reporting, michael, is that there's a flurry of text messages between her and mark meadows in the month of november of 2020. and then they abruptly stop. we don't see them again until january six. is that because mark meadows s

joining us now is barbara mcquade, the former united states attorney. barbara, good to see tonight.ed to talk to about this. this is quite a remarkable development that this kind of letter would be written. it was probably not written to be linked to the press. what do you make of it? >> it is a remarkable letter, elie. when these two prosecutors resigned abruptly as they did, i think most of a speculated that there was a difference of opinion as to the merits of this case and that they were leaving because alfred brake had said that the investigation was continuing. the grand jury activity had abated. so, we knew that they were unhappy with the direction of the case. now, we see why. although, i'm not sure degree with you that this was written to be leaked to the press. it is in such detail. certainly, alvin bragg knew all the reasons mr. pomerantz was resigning. this one was written for the press. i don't know who leaked to the press. it seemed that someone who leaked into the press hadn't agenda. i think that might be an interesting question. why is this out in the public domain?

joining me now, nicholas woo, congressional reporter with politico, and barbara mcquade, a former u.sit mean if somehow it comes out that the former president, even though he's never heard of them, did use a burner phone. or what do you make of all of this? >> i think this statement that he doesn't know what it is, contradicted by john bolton, is one of those things that people call consciousness of guilt. it suggests that he's trying to distance himself from this concept, not enough to say, i didn't use one that day, but to say, i don't even know what it is. the fact he's lying about that suggests to me, i want to look a little harder as to whether he did. burner phone is a phone that can't be traced to anybody. we know he made calls to at least three members of congress that day. he was using somebody's phone. and i think this suggests that not only was he on the phone, but he knew he was on the phone in a way that could cause him trouble. >> what do you think, realistically, barbara, are the chances that we get to the bottom of this, what really happened in those seven-plus hours,

attorney barbara mcquade said last night on msnbc it lays out a potential case >> i think it's a very significant filing because it's the first time the committee has said out loud what the crimes have been and pulled together the evidence of what that crime may have look like i think that any prosecutor who looked at that evidence in the way i did, in the way that the former prosecutors who are leading this investigation for the january 6th committee are doing, it really jumps out at fairly obvious potential crimes. >> an attorney for eastman said in part dr. eastman has a responsibility to protect client confidences. the select committee has responded to dr. eastman's efforts to discharge the responsibility by accusing him of criminal activity # we look forward to responding in due course the january 6th committee is investigating last year's capitol riots and the inevents that led to it they've interviewed more than 550 witnesses and gathered hundreds of pages of evidence. a spokesperson for mr. trump has not responded to a request for comment in this latest development. back to yo
