. >> now, she did say some controversial things including harrison prather are telling barbara walters in a famous interview that she supported abortion rights saying if she was younger, she could imagine smoking marijuana, saying that she was going to sleep in the same bed as her husband, which was sort of a taboo issue at the time. was she truly controversy at the time or was she fearless? >> she wasn't fearless but she didn't have any interest in dissembling, and, of course, it was also a time right after the nixon presidency when there was such a sense that the white house was just full of lies that she wanted to change that image, but it was also just her personality. she was completely normal and wonderfully so and very funny, and she didn't see any reason not to say what she thought. and, of course, it got political operatives all upset, and they worried about the party base and all that, but she didn't care about that. she felt the important thing was to say what she believed, and i suspect that she did better with the american people for that. her approval rating was very high

both the prosecutors in this case and the defense attorney, jose baez told barbara walters, they're concerned about casey anthony's future. there's been a schism in the anthony family. she turned out her entire family. her parents and her brother. she's had no contact with them. even though they were in the court today, they seemed to leave stoney-faced. >> the judge shouldn't base his decision on that. as a legal matter, the judge should not be evaluating the public policy implications of releasing her today, as opposed to releasing her later. what they're going to do now is they're going to go through and figure out technically, according to both the statutes and the corrections policies, in florida, how many days has she served? how much credit has she gotten? how much credit does she deserve? that's why judge perry is saying, he wants the lawyers to come back to finish this discussion. to finish day-by-day, so they can come up with a definitive date that says, okay. based on all of the callations, here's the date she's going to be released. >> what about casey's parents? what was their de

number of people who have said that the prosecution simply overcharged jose baez, told that to barbara waltersrge. here is what he said. >> that's ridiculous. the jury was given options of lesser offenses all the way down to manslaughter. so the jury had all the different options in front of them. if our theory of what happened was correct, then it was first-degree murder and we honestly believe that it was. to say that if we charged her with manslaughter they might more likely have convicted her is just not true. >> gretchen: i want to get some people's thoughts on that. judge, do you believe the jury may have had a different mindset if it would have only been manslaughter? >> not if they were following the law. and i tend to believe the jurors tend to follow the law. i think they had enough evidence for first. i know there is disagreement. if the jury rejected that, they could have certainly found her guilty of manslaughter. it was more than an option there. so i think the prosecution did the right thing to charge what they thought they could prove and what they have evidence of. not to walk

but i want to look at the challenge of walter reed living up to its path with barbara starr at the pentagon, he's a u.s. marine, i will not say former, there's no such thing. but todd, what does walter reed mean to the men and women in uniform? >> the best way to sum it up is that it's history, but at the end it's something that's very powerful because when you first arrive at walter reid, obviously you've been injured, and to be able to make that next step and see where you're going to move on in life makes it a scary place, but it's the best place that the military has to offer. >> tell us about this decision to pack it up and move it. what's behind this? >> this has been going on for years, this is part of what the pentagon calls base closure, they try and shut down either out of date or inefficient bases. in the case of walter reed, it was an aging facility showing its age, there was plenty of new medical technology that needed to be brought in for the troops and they decided rather than spending the money refurbishing the the hospital, they would move it to bethesda, build a new facili
