charles krauthammer, will he miss barney frank? we hope you stay tuned for those reports >> bill: we have been following the very disturbing story of a criminal illegal immigrant, santana gouna. the 31-year-old is charged with murdering 33-year-old jesse benavidez in texas. the wrinkle on the story is that gauna was twice deported and was being held in prison in the usa on charges of sexual assault, but an unnamed federal agency got him released from prison. allowing him to then murder benavidez. is it legal? we'll have more on the investigation in a moment. first, joining us from there's a, juan benavidez, the victim's brother. how did this crime take place? >> well, it started with the sexual assault charge and also the history of violence that everybody was concerned about from gauna toward his ex-wife. he had the sexual assault charge, was put in short custody with a county jail and immigration services, he was quickly released. few weeks passed by, there was a birthday party towards my brother's girlfriend's side of the family

that kind of a person is rare, and we all appreciate barney.love barney. >> you know, congressman, i think there's a lot of liberals, progressives across the country tonight thinking, you know, darn it, we lost another great fighter. how big of a loss is this to democrats? >> it's a loss. barney frank has deep knowledge of the institution of congress and also of the legislative process. he's not going to be replaced. it's up to those of us who have the honor of continuing to serve in the congress to be able to keep drawing the lines and fighting the fights, particularly on those economic issues which are so important to the american people, as the kind that you discussed earlier in the show, ed, where you talked about the maldistribution of wealth in our society and it's getting more and more serious and certainly barney frank's voice continues to be needed. i think as he pointed out, there are other ways for him to be heard and we certainly will continue to hear from barney frank even as he leaves the institution. >> can he do more out of the

mara, what should we make of barney frank's retirement? 71 and he has been redistricted and he has a lot of new constituents and he said it was too much for him to campaign and win over new folks. is that the story or more to it? >> that's part of it. he had to lend himself a lot of money and he had a tough race last time. if barney fran thought he would be the chairman of the banking committee in 2012 he might run again. but a sign that democrats think while they might pick up some seats, 25 which is what they need for the majority is maybe a bridge too far. one of the things we're looking at now is how many retirements there will be. that is a sign of how the party views the pros text. i don't think it's a nod yet. but there is 17 democrats retiring. half of them running for higher office. this tells you that, you know, democrats can read writing on the wall and don't think they will be in the majority. >> chris: we'll talk about the bigger political picture but stay with barney frank. steve, frank's admirers, said he was brilliant. obvi

ç barney frank knows him very well.t gingrich is out there now because i think a lot of republicans have a very short memory. he was not popular as speaker. not popular with the house caucus. this is that a guy against whom there were some 80 ethics complaints or more while he was speaker and was forced out in '98. his fundamental argument is flawed. if you want to blame somebody for the mortgage meltdown, why not blame phil graham who got rid of the protections that prevented banks from using themselves as a casino. >> it is really hard to figure out whether, how problematic it is for newt gingrich. his past is flawed, as we know. now we discover that all the things that he said about democrats complaining about freddie mac, complete hypocrisy. he was earning almost $2 million. >> just to stick with the alliteration on the ls, this guy has more personal drama has lindsey lohan. whether you look at his ethics issue, his personal behavior during the impeachment of president clinton, his lobbying which he has explanations

explain to me, barney, how pizza is a vegetable. >> well, i can't do that.nk the answer is that there are some members of congress who are vegetables. and they were easily influenced to vote for it. here was the problem. the republicans for all their talk about openness took three separate appropriations bills, put them all together and didn't open any of them to amendment. so we had the bill for the departments of housing and transportation, we had the bill from the department of agriculture, and one other, my rick perry moment they put them all three together. i forget which was the third. but the problem was we didn't have a chance to vote yes or no. and there were some very important things in the hud bill for the districts i represent. on the other hand, frankly, far worse to me than the redefinition of tomato paste was that they deliberately reduced the funding that we need for the commodities futures trading commission which is the regulator of derivatives. now, the republicans wanted to give them unbelievably less money next year than this year. this
