and then there's amy coney barrett. this is the candidate that i'm told that is most attractive to president trump because of her strict conservative record and the fact that she would only be the second woman ever appointed by a republican president. here's the drawback. she wrote a paper on the principle of decided law sets precedent and you don't overturn decided law. she suggested that if she believes the supreme court decided something incorrectly, that it should be open to judicial review. a lot of people are going whoa! roe v. wade, she will seek to overturn it. that's why you heard chuck schumer today so adamantly against anybody on the president's list let alone who he might pick tonight. >> neil: that flies in the face of justice robert who is not a fan of doing that. >> exactly. one other thing to consider, too, the president has to count on some democratic votes to get his nominee across the finish line. he believes he's got a good chance with joe manchin, joe donnelly and heidi heitkamp. joe donnelly accord

steve: with the nomination of every barrett -- any barrett make it more difficult? it would in some sense. each of these have interesting back stories. the fact she is a woman, has less experience, she could be gone after in that way. some of the things she has said as an academic make it clear that she is morally opposed to abortion and strongly suggest that she views roe v. wade is -- as wrongly decided. the other potential nominee is , theykavanagh, the other feel the same but there is not public evidence. steve: we talked about the two republican senators from maine and alaska. on the democratic side who are , you keeping an eye on? niels: the three would be the ones that voted for judge gorsuch. all of whom have already met with president trump. joe manchin of west virginia, heidi heitkamp of north dakota. joe donnelly, indiana. donnelly may be the most interesting, particularly if barrett is the nominee, because she is from indiana. so you have an additional wrinkle there with a home state selection. the other thing i think we need to look at too and this is s

amy barrett would bring the number of supreme court justices to four. i can't think of a time when someone who is a judge and that's been the recent trend here, certainly were times in the past where you didn't have to be a judge to be on the supreme court, but now seems to be a desire, so that you have someone with clear record and you know what they're going to do, i can't think of a time when someone was a judge for less than a year. she's been on the federal court of appeals put there by president trump for eight months now. so her philosophy is pretty well known but largely through law review articles, some written when she was a law clerk. so she may be a little more of a cipher here looking for a positive record than kavanaugh who has written something close to 300 judicial opinions or raymond kethledge who was looked at the last time around as well. >> and garrett, where you are right now becomes very important, montana, john tester a democrat, is running for re-election there. this november, this is a state that donald trump won by 20 points in
