>>darya: a developing story out of san francisco, the fate of barry bonds. at 11:00 a.m., and barry bonds will be sentenced after being convicted of obstruction of justice. that sentencing comes more than eight years after barry bonds testified before a grand jury that questioned his ties to the drug left. he was indicted on surgery and obstruction charges. earlier this year, the jury was deadlocked on the perjury charges but did find ferry bonds guilty of obstruction of justice. that is a condition that he and his attorneys say is a plan to fight. what they'd planned to do has no impact on the sentencing phase of the case which is today. will durant is live at the federal courthouse with more on how much time barry bonds concedes in jail if any at all. >>will: the judge who is handling the case has sentenced others convicted of similar charges to house arrest. if she follows her track record, that is probably would barry bonds would get. however, every time you get sentenced, it is a case by case situation. she may want to send a message to other people out

barry can appeal whatever happens. but the question is, is the bonds case crossing into two areas, one was the use of the steroids, which people might have one opinion about one way or the other but the other one is the lying to the grand jury. and that is something that prosecutors really don't like. and it's one thing if you're somebody that's sort of caught in the headlights, but barry's obfuscations, the way he sort of went back and forth on this, was -- was -- and he was also lawyered up. he really danced the line. joining to us talk more about this is paul henderson himself a former prosecutor and he is work with the mayor's office here in san francisco on criminal justice issues. paul, of the fact that barry was so lawyered up and so coached in his appraisals and so sort of out there, is that going to work against him when it comes to the judge? >> i think it is. that's the exact reason why the jury found him guilty was a yes or no question and his long rambling answers, exactly why the jury said that he was int

he strutted as barry kind of struts. when he sat at the defense table he kind of put his hand at his chin. you could tell he was uneasy. then his lawyers came in and talked to him and he felt better. i think they all knew he probably wasn't going to go to jail. then he kind of kept a straight face through the whole thing. he only said three words. the judge asked him have you read all the paperwork in this case an he said yes. then she asked him do you have anything to say. he said no, ma'am. i guess if i had a wish it would be when she asked him that question he would have said you know, i do have something to say. let me tell you what really happened. he wasn't going to do that until the attorneys said don't do that. >> guys like barry to play. there is a lot of playing going around about it. >> yeah. it is really -- that is kind of the biggest story in sports now in the bay area. where all these teams are going to end up playing. they are shuffling around. i'm most interested in how the a's situation is going to play

barry bonds was acquitted of obstruction of justice. federal sentencing guidelines call for a sentence of 15-21 months. bonds will not likely serve any sentence until the appeal is final. there are things that bonds could do/should do while his appeal is heard. >> the court of appeals will look more favorably on his case if he's already engaged with the community. he's done a fair amount of community service. the question is will he do any community service related to this. he's never admitted to steroid use. he can't go represent to the community about steroid use. on the other hand once the case is done, he doesn't have any jeopardy. he's only worried about the hall of fame after this case. >> reporter: so far no baseball player admitted taking steroids had received the votes needed to get into the hall of fame. bonds' major league baseball all time hall of fame leader. bonds is accused of taking steroids to approve his power. anderson served more than a year in jail following that for refusing to testify against bonds. reporting live
