barry simms has been in court all day. he joins us with the latest developments. >> the judge tossed out 11 of the charges against dave. they decided not to prosecute 12 others. the jury will charge of second- degree rape, assault and perverted practice. now let's tell you about the dna evidence. >> prosecutors presented a key part of the investigation into the sexual assault of a 12-year- old girl. they also included an explanation on why their case did not include any dna evidence. he is charged with the august 14, 2010 rape in woodlawn. the victim claims that they dragged her into -- a director into a storage room and forced her to do sexual acts on them. she found the dna of the co- defendants on the victim and on the victim's clothes. jurors were told there was no dna match for dave. dna cannot prove guilt or innocence. it is a small piece of the puzzle. the main reason dna is not found in the sexual assault include the use of a condom, the person cannot produce sperm or had a vasectomy. the dna was there but not dete
