how this man ended up restrained and face down at the bart station. this is the federal civil rights case brought by 43-year-old kenneth caruthers facing damages against mehserle and four other officers. this happened in 2008. caruthers got upset after seeing five officers standing around when his car was previously broken into, but the officers were apparently station there had as a presence, a safety presence after a concert. the defense attorney says despite being warned to stay away he did not and mehserle believed he was going to punch an officer who didn't see it coming because he saw a clench fist. so he brought a leg sweep to bring him in with the other officers subduing him. he said he was hog-tied on the ground and only his legs were restrained. the jury is made up of six men and two women right now are listening to the testimony of former bart police chief gary gee talking about policy this morning. nowhere was there a mention of oscar grant, the bart rider shot and killed by mehserle weeks later. mehserle served two years for involuntary m

and bart expects delays. 12th street station has remained shut down since the very beginning this morning. and they are running straight through. so you can use 19th instead. and also, ac transit is being delayed or reroited and you can -- rerouted and police are still showing a steady line of police and 14th and broadway. freeway traffic by the way, 980 and 880. that is not impacted. and let's go to south san francisco. we have also been following this traffic alert in the last few minutes or so. lanes are reopened southbound 101 at grand avenue. this is an injury crash, involving up to five cars. and for a while, traffic was stacked up toward oyster point. we had fire trucks blocking all lanes. and the good news is that you have been able to reopen all lanes. a little bit ahead of schedule actually. so if you want to avoid any kind of delay for right now. you can still use southbound 280 and cut over toward 380 but hopefully we will be able to see some improvement there on the sensors here coming up shortly

abc 7's wayne freedman reports what bart called standard is seeming like favoritism to the protestor autos this is cell phone video from last night z a mercedes-benz trying to cross through them. it shows a protestor jumping in front of the car banging on the hood and this driver hitting his gas, knocking down one in front, another in the back. both went to the hospital. bart police responded and witnesses told them what they saw. >> all he had to do was wait a few minutes. you don't attempt to murder someone for someone slapping your car. >> this is in the hands of the experts, now. >> bart said officers had no breathalyzers. >> they observed a driver and got his identification. wrote that down. they didn't see that he was intoxicated. >> the crowd wanted an arrest. bart officers released the driver knowing full well that the crowd would react angryly, which it did. >> what did we do? >> if i ran someone over, where would goi? >> police tried to depart, the car surrounded their car. the incident remains an issue. occupy oakland supporters have pictures of the driver in question, all
