closing bell ringing in 36 minutes. trading wars are heating up in the new york stock exchange, kind of losing the battle for buy and sell orders. charlie gasparino on who is winning. he's burning up the blackberry as he heads to the studio with all the latest developments, as he passes the big photographs of all of the talent here. liz: six years ago people weren't even talking about these things, but it is official, the dreaded dark pools as they are known are now beating the new york stock exchange in the war over trading volume. charlie gasparino has the exclusive details. first explain to people what that means. >> a dark pool is essentially an exchange -- i think it was passed back in 05, 04, sec rule says that, you know, you can trade -- you don't have to send your orders your trading orders like merrill lynch doesn't have to sell all its buys and sells to the new york stock exchange, where you can match, where you did in the past, now you can send it to other places. those other places nobody really knows. they

will it happen before the bell? we are on it as we are watching as history may be unfolding on the stock market on a few different levels. we'll tell you. >>> all right. another day of huge interviews here on the "closing bell." we have treasury secretary, jack lew, in his first sit-down since taking the post. and the chairman and ceo of i.c.e., the intercontinental exchange is here. if all goes as planned, jeff spreker's firm will soon earn this place here, being the new york stock exchange, and he has some very interesting things to say about this rally, of course, as does jack lew. >> that's pretty amazing. spreker took his company public in 2005. it if goes as planned, he'll take that company to a $20 billion firm. let's show you the markets. up 62 points on the dow jones industrial average, sitting at 14,517. nasdaq composite also higher, up about ten points on the nasdaq. take a look. technology mixed to higher, at 3,254. and the nasdaq higher at 1,650. >> much to talk about. watching for the s&p all-time high

over at bell curve trading. what is this?well, liz, i think when you look at the s&p you, first of all, you've got to be clear about what your time frames are. in the short term, i don't disagree. i think the short-term momentum's still bullish. i think you could see the market push back toward the all-time highs, 1576 in the cash s&p, 1586 in the futures. but when you take a step back and you think about where the s&p 500's going to be three months down the road, six months down the road, it has been a disastrous strategy to have your maximum equity exposure at these levels. look at the peak in 2007. look at the peak in 2000. liz: okay. so hold on. stop. so the peak in 2000 had the fundamentals of the dot.com inflation, right? i mean, the inflated bubble, that was great, and then the peak in 2006, early 2007 as you see these points, that was the housing bubble. okay. so you're saying we, we don't have similar strengths here, but those were bubbles in and of themselves? >> right. but go back, liz, and look at what the economi

we're coming up on the opening bell.t point towards what will happen when the real trading starts. they call it the futures. okay? and right now those futures, the future indicators suggesting a gain of maybe 60 points for the dow. that would take it above 14,300 right there from the get-go this wednesday morning. and also, we've got the nasdaq, the home to big tech stocks. the nasdaq moved to a highest level since november of 2000. when the dot-com bubble was bursting and the nasdaq was coming down. well, we're back to that level. all right. let's see what happens now. the opening-- when you hear that bell ring, that means that they're getting ready to actually start trading. now it's precisely 9:30 on our atomic clock and they're trading. and oh, my goodness, buy something, somebody. yes, thank you very much. the dow is now up 7 points and the opening trend, i was right, it is higher. 14,269 and counting. 14,271. away we go. now, the big stock that's really driven this rally had a lot to do with driving the dow higher,
