now he's in bellevue, he's sick and then you've got the california case coming.does he go to jail for the rest of his life? >> obviously, his health is a concern. he's 67 years old. so the top charge that he was convicted of in new york carries a maximum of 25 years. and a minimum of five. whether or not he gets the maximum, i don't actually think he will. there's a lot of factors that go into the decision. but he's seeing significant time behind bars and the prosecutors in la have said, looks, we're not going anywhere. we're still intending on prosecuting these cases once your new york situation is figured out. he's going to have another trial to face at some point. cheryl: does he go to california and physically participate in a trial or does he go to jail in new york? >> what's probably going to happen is he's going to go to jail in new york and prosecutors will work with new york to see how do you get him there for the trial. it becomes more difficult to levy your defense behind bars. that will happen while he's incarcerated. cheryl: we thought the markets we

sentencing and he was to be remanded to rikers island, but on the way there last night he was taken to bellevue hospital due to chest pains and heart palpitations. weinstein is expected to be sentenced march 11th. he faces a minimum of five years and a maximum of more than two decades in prison. the conviction of harvey weinstein is seen as a triumph for the me too movement and comes two years after two investigations into allegations against weinstein were published by "the new york times" and "the new yorker." >> it's hard to know how this is going to reverberate throughout history, but i think that it will definitely send a message that this is a moment where survivors will be heard and will be seen and in cases like this will even be believed. >> reporter: the jury deliberated for 26 hours over five days and acquitted weinstein of the more serious charges of predatory sexual assault and first degree rape. weinstein's attorneys argue the justice system failed their client. >> did harvey weinstein get a fair trial? >> i don't know if harvey weinstein could get a fair trial. >> i don't know if

yesterday after he was convicted, he tossed that walker and he went to the bellevue hospital.u worry that justice won't get served? >> that's the next hurdle, sentencing which is scheduled for march 11th. we'll see if he'll be sentenced with the third degree rape charge he's looking at 18 months to four years a wand the criminal sex act he's looking at 5 to 25. i doubt he'll get the high end of it. that's a lot of things that people don't realize. that when it comes to sexual assault cases and rape cases, the actual sentences are not that high. you'd be quite surprised. there are people in jail serving longer sentences for drug use and drug sale than rape i think many of us agree that rape is the more serious crime. i would be surprised if he doesn't get the high end, but he needs to go to rikers like everybody else. until he gets that sentence. >> what does this do -- does it do anything culturally to your industry? to your business? >> i think the fact that yesterday harvey weinstein was made an example of the type of behavior in the industry which is unacceptable but not ju
