there was a desire to make education for berea open to all. as far as we can tell the actual policy was they did not make a distinction among applicants by race. the only requirement was a willingness to be educated in a coeducational college. and of course it was also a private school. >> you assume in your argument race is the only factor that gets someone into a school. can you point to any application? you cannot use race exclusively. but, you can use it as one of many factors. >> we have quarrels with a lot of that. in a zero-sum game like college admission some people will get in and some will be excluded. >> what are the facts here about whether rice is being used singularly to let people in? >> the expert unc presented argued 1.2% of the decisions were influenced by race. we had disagreements with the characterization of that. given the fact they received 40,000 applications your, that's hundreds if not thousands of applicants affected by race every year rx to testimony was race made a difference in each admissions cycle. >> from the b
