bernstein was a former editor of the san francisco chronicle. it goes to the political nature of this case. on a factual basis alone, the fact stand for themselves. to ignore the politics of this case, to ignore the political reality, to ignore the facts they were key players in this case, and to not allow their testimony would be a great injustice. if i may go back to former mayor art agnos -- i would respectfully request to at least permit us to call him as a rebuttal witness, in the event that, based on mayor lee's testimony. >> i think we can reserve that decision, but i would not preclude that. do the commissioners have views on mr. bronstein? i am sensitive and cognizant that the sheriff is trying to put on a defense, and i do not want to hamper the defense of the case. but i am really having a hard time, in light of what i heard, seeing how phil bronstein is going to have anything probative. this should not be about politics, which i agree with. i am having a hard time seeing this. >> regardless of what we say, when the live testimony of

grand juror which is a no-no, and then it was explained that bernstein, they claim, didn't know she juror when he went to knock on her door. >> that's the weakest part of the woodward and bernstein argument today, that they didn't know she was a grand juror. as an investigative reporter in florida, i talked to a few grand jurors and i broke the law, okay, and i never said anything about it to protect me and to protect them. >> you're acknowledging on this program thaw broke the law. >> you're saying it's not unusual? >> i'm just saying so long the story is true and accurate, as long as you don't use that as a one source and they did not, okay, i think it's correct. >> one of the interesting things here -- there's an excerpt in new york magazine. is woodward's strong reaction to putting this in the book. he tried to press him to not use those -- i talked to him yesterday. he said bob pretty much taught me everything i know when he gets on for a story, he pushes the story at whatever cost. personal allegiance is not the yard stick he uses. i felt an obligation to report it. himmelman

let's get right to meteorologist howard bernstein with your forecast first. howard? >>> good morning. right now growing into effect a heat advisory covering the washington and baltimore metros, especially away from the bay, down to fredricksburg, culpeper, up to frederick and leesburg, montgomery, prince george's county, fairfax. this is borderline for the weather service but it's early in the season. today we're looking at some temperatures which will make it into the lower 90s. that's a big storm blast that caused an early cancellation of the memorial day concert on the mall. they got some of it but had to pull the plug on it to get people safe. lots of sunshine. there's nothing that's developed just yet but temperatures with the bright sun really responding. all to 86 in baltimore. 85 southern maryland. fredricksburg 88. we're sitting at 84 degrees. when you factor in the humidity, that's when things get a little more difficult. a lot of people will be outside this afternoon whether at a parade or barbecue. we've got indexes already high. feels like 88 in washingt

right to meteorologist howard bernstein, he's got your forecast. howard? >> the weekend is not looking all that bad with you we have to get there -- but we have to get there first and the problem the severe weather threat we have today. the areas in yellow you see, they believe all these folks including much of our region has a threat for severe thunderstorms with damaging wind gusts or large hail possible in the strongest of those storms and you can see it includes us, the whole i-95 corridor. you get out west a little bit the threat isn't there but we've been watching this one cluster of storms, it's weakening. it's diminishing but it's right on top of us and it still has quite a punch coming through the metro and a few new storms fire up toward frederick right now. and that's headed toward oh, woodsboro, walkersville, maybe over to new market moving east/southeast. but the storms near washington now and by the way nothing is severe. no warnings, no watches. this is sort of maybe the first of what could be two or even three rounds in spots i think before

a busy week and joining us to help explain what it means, richard bernstein, ceo of bernstein advisers. good to see you again. let's talk facebook. big day on friday, obviously. the company going public in a highly anticipated offering. big day for the stock. is this something the retail investor should consider buying? >> i don't think so and i'll tell you why. first of all we've seen massive outflows from equity funds is louisiana six, nine months. it appears individual investors believe they've found the investment. so you won't invest in a diversified mutual fund but you'll invest in one stock? that doesn't make any sense to me. the other thing is i think, look, you want to be the banker in a town where there's no other banks and there's 100 lenders. you're the only one in town, you're going to get a great rate of return on your lending. what we have here is the exact opposite. we have 100 lenders and only one borrower, your rate of return has got to be over, it's supply and demand. >> in other words there's so much money going into this stock right now. priced at $38, it opened mu

we have jared bernstein. we welcome back republican conference chairman jeb hensarling of texas. hensarling, i was happy to hear that you were going to extend the bush tax cuts. i wanted to ask you, would that extension be temporary? would it be permanent? when do you reckon you'll take your vote? >> take it soon, because obviously the market needs some certainty, particularly after we looked at the last jobs report. third straight month where job growth has decreased. we now have -- looking at the labor force participation rate, the worst employment record of an administration in 30 years. so we need some certainty. frankly, we want to go beyond that. we need a tax cut that is fair, flatter, simpler, more competitive, which is what we have in our budget and the president threatens the single largest tax increase in america's history that, number one, would even forget decimate the economy, and number two, doesn't even make a dent in the $11 trillion of additional debt that he's going to plow on this economy as he drives us down the road to bankruptcy. >> it sounds to me that the

eliot: just so we understand what the controversy circles around one the claim that woodward and bernsteinry, something that had been ambiguous and second, the notion that ben bradlee, who is a demigod in washington circles wasn't 1,000 convinced about certain aspects of the way the story was reported. is that right? are those the centerpieces of this? >> that's correct. the grand juror, it's not a claim, it's a fact. they said they did speak to a grand juror. that's the larger piece of this. the interesting historical piece. but what has caused the firestorm more was the stuff about ben's doubts about the hollywood portrayal of deep throat. in the reportings of of the "washington post" but its doubt about of the how old story of the executive editor of the post. he was responsible about what went in the paper. he said you cannot hold me to the film version of this. >> eliot: just so it's clear none of it goes to the facts pertaining to the watergate break, the cover up and any of the substances that was historically reported in the newspaper? >> that's correct. >> eliot: at that level i w
