we're standing right outside beth israel hospital. he was brought here a short time ago. when we first got on the scene, we saw an ambulance pulling up near beth israel flanked by ten motorcycle officers. almost a caravan escort bringing that ambulance in here. if you remember, this is the same hospital basically where his older brother was brought earlier on friday morning. and he died. when he came here and when -- we try to think of injuries he may have sustained, we're hearing that his injuries were probably sustained in that gunfight. in that altercation that happened very early on friday morning. if that's the case, you can look at some of the injuries that his brother had received when he was brought here. he was in cardiac arrest. the chief of emergency medicine here said his brother had suffered multiple gunshot wound, as well as what appeared to be an -- injuries from an explosion or a blast. we don't know if the younger brother has suffered those same injuries, but his condition is being described as serious. not critical but serious. and we're also hearing that

molly is in beth israel hospital with more. >> we are getting information out of a capitol hill briefing from two law americas telling fox news fbi investigators feel they were cut short in the questioning of the suspect at the hospital. they say the federal magistrate as well as the public defenders and prosecutors showed up 16 hours into their ability to is a question him. they received intelligence on the older brother tamerlan that the cia was also contacted not just the fbi and contact was made in september of 2011. given some of the fbi information that had come out six months earlier tamerlan, they were given the same information that the fbi was given months before that tamerlan was a follower of radical islam and wanted to join overseas groups and his name was added to a data base of known suspected terrorists. the father of these brothers plan to travel to the u.s. as early as today. he proclaimed his son's innocence. he said the family these two brothers had been framed over the course of these events. they hope to take tamerlan's body back to russia. >> there is word that the

attorney's office saying the hospital, beth israel, upgraded the suspect's condition to fair.es that mean? >> yeah, you know, when you go from serious condition, which means that the person's vital signs looking at the heart rate, blood pressure, things like that, are stable but still going up and down a bit, a little bit concerning, still requiring intensive care unit to fair, that basically means that things have now become stable and stayed stabilized, which is, you know, you and i were talking about this last night, it's exactly what you'd expect. sounds like the operation that was done was done on saturday. we're now three days after the operation. and it's pretty standard for a patient with that sort of condition to be improving steadily. so, it basically means i think doctors would say he's out of the woods. the biggest concern time is over. there's still concern about things like infection, obviously, and further operations he may need. but i think it's a very good sign overall. >> still, what we don't know is how much authorities will be able to continue to talk to hi

this morning from beth israel hospital.here because he's now in stable enough condition and is able to sit up. he is a lot more responsive than he was just a few days ago. he went through something called an intake screening process. it's a step by step process, brought here in handcuffs by u.s. marshals. we're told the first step of that process is he was strip searched. right after that he went through a medical screening. obviously once again in stable condition. more responsive now than he was before. he went through a psychological screening to make sure that he wasn't in danger of hurting himself. i'm told here by a representative here that the result of that psychological screening determined that he was not in danger of hurting himself. he was also fingerprinted. a dna sample was taken from him as well. and then he was photographed. then all of that material was given and turned over to the fbi. that entire part of the process, wolf, i'm told took just about an hour before he was then transferred to his cell. wolf?
