joining me now, billy murphy, the gray family attorney. thanks for joining us.ere you surprised by the mistrial today? was the family surprised? >> no. this is an obvious possibility in a case like this, because people from different parts of the community have a totally different perspective on policing. and officer friendly lives in the white community and officer un-friendly tends to live in the black community. so i'm not surprised. >> we were talking just to our legal analyst, jeffrey toobin and sunny hostin before the break. both of them thought perhaps this was a rushed prosecution. that the charges were listed very quickly after the death of freddie gray. do you think the prosecutor moved too quickly on bringing this first case to trial? >> no, i think they brought a straight forward case. it was an obvious case to bring. and i don't fault the prosecution at all for the speed in which they accomplished their objective. it's going to be a fresh start, as you know, anderson, because the prosecution is going to go forward with, again, a second trial for off

" the defense and prosecutors met with the judge today... and will meet at least one more time before deciding whether or not to retry porter. an arraignment hearing has been set for the army sergeant bowe bergdahl facing desertion charges. the army announcing today... the hearing is set for december 22nd- at fort bragg-north carolina. earlier this week the commander of u.s. army forces ordered bergdahl go before a court-martial. bergdahl is facing desertion and endangering fellow soldiers. the army sergeant left his base in afghanistan in june 2009 and was held in captivity by the taliban. he was released last year as part of a controversial prisoner swap. a man is in police custody.... after going on a deadly shooting rampage on an oklahoma interstate. police say a couple was in a car on the interstate early this morning... when another driver tried to run them

and billy murphy told supporters they should look at what's happening next. >> i'm not going to second against the prosecution, and not second guess the defense. they're all competent, hard working lawyers, who did the very best that they could, and i'm sure that they're all disappointed. but i don't buy the nonsense that this is not a victory for either side. it's not, it's a bump on the road to justice, and the road to justice has lots of bumps. >> reporter: i think that those words have been heard by the people of baltimore tonight. and limited protests. >> where does this go from here, john? >> well, there's a meeting tomorrow. and the judge is calling together all of the attorneys, and they're going to meet to discuss the second trial of officer porter, and we do not know where that will be. the second trial of the sequence is january 5th. i want to bring in billy murphy, the attorney representing the family of freddie gray. ly disappointed, billy, by this mistrial today? >> they're disappointed that there wasn't a verdict, but they're not upset. and they're calm and they're waiting for the next trial. and they're urging everybody in baltimore to be as calm about it as they are. they have a vital stake in this. it was their son, after all. >> right. >> and they are familiar with the baltimore city police brutality problem and the national police brutality problem. and nonetheless, they are advising everybody to remain calm and patient. >> were you personally surprised that there was a mistrial? >> no. about 5% of the criminal cases tried in america result in a mistrial. of the ones that are re-tried, about 70% result in a conviction and 20-some percent result in an acquittal. so this is just a bump in the road on the way to justice. >> what about the five other baltimore police officers. they have upcoming trials. what do you think is going to happen there? >> because this one was a wash, i don't think it'

joining us now from baltimore the attorney for fred from gray's family billy murphy.of all, mr. murphy. >> how are you doing? >> i'm fine, sir. was it a fair trial in your opinion? think both sides got an adequate opportunity to present their cases and the jury selection appeared to be fair. it was a representative jury of a cross section of the baltimore community and black judge who was misconduct what more you can ask? >> you don't have any beef with how the trial was conducted. in a hung jury we don't know what the polling of the jury was. like how many people wanted to convict and how many people wanted to acquitment, is that correct? you don't know that? that's correct. we don't know. we doe doo know the prosecution was able to convict some of the jurors there was proof of a reasonable doubt of some of the crimes that were committed and we do know the defense was able to convince some of the jurors that officer porter was innocent. >> okay. now, in cases like these they will have to be retried and then the prosecution has advantage i understand 69% of retrials e

as attorney billy murphy was saying, this is not an acquittal of this officer. it's one of six trials and it means that a jury of 12 people, 8 of whom were african american, 4 of whom were white, were unable to agree as to the charges. do you feel there will be political pressure on marilyn mosby to refile? >> i can tell you if marilyn mosby was a prosecutor who went with the politics of this, there would be more, you know, it would be a different situation. he doesn't strike me as somebody who is particularly looking at that. because she outraged the police unions when she filed these charges and typically even democratic prosecutors tend to not file on officers or tend to throw it to a grand jury. so i think if he was a politics prosecutor, she might have empanelled a grand jury as so many do. she went head long against the police union in this instance o so i don't think that's what she'll be thinking about. the biggest trial which will be of the driver, he faces the most serious charges, a depraved heart murder. that's actually the biggest case. interestingl
