plus lauren blanchard who's live in washington with more on the decision in texas. eric. well, a judge may have ruled the affordable care act unconstitutional, but obamacare will remain in place for now because even the white house has said they know appeals are coming. let's break down the decision. a conservative federal judge in texas, reed o'conner, ruled the affordable care act invalid because he said it knocked out the constitutional foundation, and the judge says obamacare cannot be separated from that provision. now, less than a week from a possible government shutdown, this is likely to become yet another divisive issue for congress. >> congress failed to repeal and replace it as many of us had promised. that was, you know, that's on us. that was a terrible failure of the congress. but maybe this will cause the issue to be revisited. >> if this ruling would be permitted to stand, 17 million americans would lose health insurance, so it'd be devastating for the american people. >> reporter: if the lawsuit makes it to the supreme court, as many think it will,

lauren blanchard is live now in houston, there's been an outpouring of support for the former presidentright. about an hour ago, the motorcade and hearse carrying the flagged draped casket of george h.w. bush left the funeral home behind me here in houston as it made its way towards elling ton airfield. that is where that is waiting for this motorcade to arrive carrying members of the bush family as well as the casket of the former president and it is expected to be taking them to washington d.c. for one last time. this community was really remarkable to watch as this hearse left this area. there were people lined up on the roads just outside of here taking photos and wanting to see this president who was here for this community. great in their eyes because he was such a member of the community. they were waiting to see him as he left one last time from this funeral home just watching that precession and motorcade, there were a few dozen folks lined up just watching this all very somberly. it's been remarkable to be in houston as this is happening and folks have been reflecting on the l
