joining us now from atlanta, nbc news correspondent blayne alexander. at's expected to occur today? >> reporter: well, jose, good morning to you. certainly, a lot of moving pieces here. lest start with jenna ellis. of course, she is the former legal advisor for the trump campaign, but for the purposes of 2020, as relates to 2020, prosecutors are interested in the role that she played in setting up a number of legislative hearings here in georgia, essentially, that's where rudy giuliani, we've heard a lot about this, where rudy giuliani came forth and made a number of false claims about georgia's election. well, prosecutors want to, most likely, question her about the role she played in setting up those legislative hearings. now, as for governor brian kemp, that's the other thing we're following very closely, and it's fwhn contentious relationship between governor brian kemp and d.a. fani willis has spilled into public view as we've seen a number of court filings back and forth. attorneys for the governor are arguing that he should not be forced to testif

let's go to blayne alexander joining me from atlanta with more on this. blayne, welcome.do we know about this investigation and what can we expect to see tomorrow? >> reporter: alex, we do know this has been a busy 24 hours for this investigation. not only did we learn that rudy giuliani has moved from witness to target in the das investigation, but we also learned in the same 24-hour period that senator lindsey graham, his motion to quash the subpoena was denied by a federal judge. he's now been ordered to appear next week. let's focus on giuliani. what we're expecting to see tomorrow is he is going to be testifying before the special grand jury in a downtown atlanta courthouse. aside from that, we're not going to see too much or hear too much. we do know a lot of this is centering around his statements to georgia lawmakers in december of 2020. it's important to remind us why the d.a. wants to hear from us in the first place. all this centers around statements he made around legislative panels essentially which he came forward and peddled a number of conspiracy theories

joining us from atlanta is nbc news correspondent blayne alexander.iani to be named a target in this investigation? >> reporter: jose, it means his status has changed. according to his attorney as recently as yesterday he was notified that he was a target. up until that point he believed he was a witness and that's how he was considered by the district attorney's office. it means there is a possibility that there could be an indictment against him but certainly doesn't mean that's a guarantee. all of this, of course, comes amid a very busy 24 hours in this investigation and the timing of this is also notable. that's because giuliani, as you mentioned, is set to appear and testify before the special grand jury tomorrow. let's talk about why he is a key figure in all this. all of this is centering around a number of statements that giuliani made in late 2020, december of 2020 in front of georgia state legislators, it was a series of panels where he peddled a number of conspiracy theories about georgia's elections. during those hearings, he essentially a

i'm joined by nbc news correspondent blayne alexander in fulton county for us. talk to us here about what's happening, what this judge is going to be deciding? >> reporter: well, lindsey, that hearing went for a couple hours today. no decision today. we're expecting it in the coming days from that judge. lawyers for georgia governor brian kemp were arguing to quash the subpoena, essentially arguing several things -- one, they're arguing a series of things, one, executive privilege and attorney-client privilege. they're also arguing sovereign immunity. third, they're arguing there could be political implications from this because we're so close to the election. now what's interesting about this, is the legal filings and almost the day in the courtroom, is kind of the crux of their argument, but also something that judge said he didn't want to hear about, saying this was not the proper forum to discuss those political implications. this is what the attorney for brian kemp had to say today, essentially arguing that we are getting close to one of the most closely wa

nbc's blayne alexander is in atlanta. blayne, why is the d.a.o meadows and powell, and do we know if they'll try to not show up? >> lindsey, good to be with you. she's kind of laid out why she wants to hear from these individuals and what she's hoping to get from their testimony. the d.a. has made it clear all along that she's going to do a robust investigation. that she wants to hear from anybody who had even proximity to former president trump and can give any sort of insight into his mind-set, into his actions, regarding the 2020 elections, specifically here in georgia. i want to read to you a little bit of what she said regarding mark meadows. she said, essentially, that the witness possesses unique knowledge concerning the relevant communications between the witness, former president donald trump, the trump campaign and other known and unknown individuals involved in the murlt-state coordinated every to influence the results of the november 2020 elections in georgia and elsewhere. that really kind of underscores all of it. that's from d.a.

blayne alexander joins us with the latest. >> reporter: that certainly is something that is notable.go, the attorneys for brian kemp went before the fulton county judge and asked to quash the subpoena altogether. the judge ruled that is not something that is applicable. his attorneys were arguing sovereign immunity. they say the governor must testify, go before the special grand jury that's looking into alleged election meddling on behalf of the former president, but what's notable here, this is somewhat of a victory for governor kemp or a semi-victory. they were saying if you don't quash the subpoena altogether, at least let us delay until after the election. attorneys for governor kemp said his role and his re-election bid is reaching a crescendo and it could have political implications if he's forced to testify beforehand. what's notable about this, this is coming at a time when we're seeing this investigation continue to widen. in fact, it was just the end of last week that the d.a. filed a motion saying she wanted to hear from several other people close in the trump orbit includ

to help us break all this down let's bring in nbc's blayne alexander in atlanta and harry litman, former u.s. attorney and former deputy assistant attorney general. blayne, what's the latest at the courthouse? >> reporter: well, chris, we know it's been almost five hours now since rudy giuliani and his counsel walked into this downtown atlanta courthouse here behind me. so that testimony is still going on. now, of course this is all secret proceeding. this is grand jury testimony. so he's behind closed doors testifying under oath. so we don't know exactly what is happening inside that room, how he's being questioned or perhaps more specifically how he's answering those questions. but before in the days leading up to this his attorney did give some sort of indication as to at least the questions that he would not p answering. he said that giuliani would stay away from any questions about conversations he had with former president trump and that he would claim attorney-client privilege. so that's that. but the other piece of this, the big backdrop that makes all of this something we're wat

joining me now, nbc news correspondent blayne alexander in atlanta, as well as political reporter and msnbc political analyst greg bleustein. what does this ruling mean for the governor and the d.a.'s investigation, big picture? >> reporter: well, let's start off with the timing of this, alex. it looks at the fact that we have an election coming up. as the governor's attorneys made the point in court last week, they say it's one of the most closely watched, if not the most closely watched gubernatorial race in the country. so they were saying listen, if he is required to testify, at least let him delay that testimony until after the election is over, because they didn't want what was happening to seen into the politics leading up into election day. and the judge said that's fair. the judge granted that, essentially said he doesn't want this to be influenced in any way, but he said as soon as that election is over, he has to go to the d.a.'s office and make arrangements to testify. now, it's notable that the d.a.'s office kind of pushed back on this. remember, she has this grand jury i

as far as what a target means, one of our colleagues here at nbc news, blayne alexander, is out to the district attorney's office, trying to determine what that is. if it was the federal system, i could spell it out for you, because there are actual definitions in the u.s. attorney's manual. what exactly is subject and the target is in the federal system and a target would potentially indicate somebody is about or is likely to face charges and there's criminality has been found. i don't want to go that far here, but that's at least what we know according to robert costello, the attorney general for giuliani, as far as this resignation. he had been called a material witness before, hallie, in court filings to compel giuliani's testimony. he's still expected to deliver that testimony and appear before this grand jury on wednesday of this week. >> tom costello, giuliani's attorney, says he thinks prosecutors, in his words, delusional, if giuliani is going to talk about conversations he had with former president trump? >> exactly right, citing attorney/client privilege. basically, when the

blayne alexander has more on that. grand juries meet in secret, do we know what giuliani testified to? >> reporter: we do not know what rudy giuliani was asked under oath and after that testimony yesterday his attorney declined to discuss any of the specifics. but we do know that it very likely centered around statements that giuliani made to georgia lawmakers back in 2020 just on the heels of the presidential election where he came forth and made a number of false claims and conspiracy theories about the election here in georgia. beforehand his attorney did give some sort of indication as to what giuliani would not talk about. he said that giuliani would not talk about any conversations he had with former president trump citing attorney/client privilege. >> heading into this, giuliani was informed by the prosecutor that he has become the target in the probe, it's a term of art, meaning he could be indicted himself. what kind of charges potentially would that mean? >> reporter: the da here in fulton county has indicate
