bnsf has taken numerous action to ensure the fluidity of our network. during the 11-day shut down of port operations that occurred in 2002 freight permanently migrated away from the west coast. this is a potential long term consequence from the situation. congress can play a role in keeping goods moving through sound infrastructure policy. my written testimony details bnsf's thoughts in those areas. thank you. i look forward to your questions. >> thank you. next we have dr. walter. she's the chief economist at moffit. welcome. >> good morning. it's well recognized that international trade is increasingly important to the u.s. economy and that this trade mostly utilizes ocean going vessels particularly container vessels due to the versatility of containers to handle a range of cargo to liquids and gases. ports have an important role in the movement of overseas freight because they are major intermodal exchange ports transferring cargo between ships and rails. they are the embodiment of intermodalism. ocean liners are adapting to growing trade volume. i w

we did not deliver the service that customers had come to expect from bnsf. we have moved quickly and implemented a $4 billion capital improvement program in 2013 followed by a $5.5 billion program in 2014. we have announced a $6 billion capital budget this year. with. investment we have permanently expanded the capacity of our network which we believe will continue to maintain the u.s. supply chain advantage. the san pedro bay port complex comprised of the ports of los angeles and long beach is the busiest container port complex in the western hemisphere and a top gateway for u.s. trade with asia. the bnsf transports half the international shipments that go out of these ports and 75 prsz of these units carried by us are loaded on dock. the remaining are handled off dock at bnsf's hobart yard in east los angeles. the facility is 24 miles by highway from the ports. bnsf has been, woulding for well over a decade to build a near dock facility only four miles from the ports called the southern california international gateway or scig which would be the greenest i

what bnsf has been very focused on is improving our velocity. because as you very well know, when we look at the speed at which we can turn these assets we can turn more capacity in the supply chain in the market if we invest in our infrastructure if we have expansion in our infrastructure. so we have a very thoughtful approach to investing so we can get the velocity we need which will generate the capacity for the midwest to be able to have the containers that they need. >> anyone else? >> there was a structural deficiency for the exports and our exports tend to be agriculture, large scale capital goods and energy products, and these come from places where not a lot of people live and therefore, not a lot of containers arrive full of imported goods. so there is a structural gap that has to be addressed. and from where i sit and what i've seen in the data, i don't think it will be addressed very simply by trying to match or reposition containers because every time you have these congestion issues, things do get paralyzed. it may be necessary to

. >> with bnsf ms. farmer i'm sure you have to look at the possibilities of a shut down and a shut down that would last possibly annex extended period of time. how does that effect the railroad and your planning and what effect does that have on your customers and your thousandes of employees that you have. >> an example would be this weekend we were notified by the pma that vessel gangs could not be working. so the effect that has on our railroad is that in an average week during this period of the year we would be moving somewhere in the neighborhood of 60 trains off our docks in southern california. that number has been reduced to 30 trains per week. the impact that that has is that we cannot move the freight that wants to move off the west coast. so we will move a limited amount of that freight off the west coast into the interior of the u.s. it will then limit the ability for us to accept freight at our inland hubs. so we will have to turn freight away at the inland hubs that wants to move back to

that's the application of race so in a case that a month or so ago hall versus bnsf there was a guy who got married to his husband asked for health insurance and didn't get it filed suit saying if i were married to a woman i would get health insurance. the employer put in his brief the classic line orientation is not covered under title vii and the court denied him judgment and said i'm reading the claim. i'm reading the complaint and it's as if i were a man married to a woman i would get health insurance. i'm a man married to a man so i don't and that sex discrimination. the court said i don't see anything about sexual orientation. but of course i think now that social norms have changed the legal logic was always there but now that social logic has changed and in a way social logic, cultural logic had cultural logic have to change before legal logic prevail in courts could actually see the words in front of them. so the last piece these because i want to leave time for questions. let me conclude with this. 50 years ago congress passed title vii of the civil rights act of 1964 and set

and so in a case that just came out a few months or so ago, hall versus bnsf, there was a guy who got married to his husband asked for health insurance, didn't get it. filed suit saying if i were married to a woman i would get health insurance. the employer put in its brief a classic like a sex orientation is not covered under title vii is the sexual orientation orientation claim and the court denied summary judgment and said i don't know i'm reading to claim, reading the complaint and it's as if i were a main grid to a woman i would get health insurance. a man married to a man and so i don't. and that's sex discrimination to the court actually said i don't see anything here but sexual orientation. there was anything but sexual orientation because, it's just now, i think now the social norms have changed, the legal logic was always there. but now the social logic has changed. and in a way social logic, cultural logic had to change before legal logic could prevail. and courts could just actually see the words in front of them. so last piece because i want to leave time for questions. l
