bnsf are loaded on dock. the remaining are handled by the hobart port. bnsf is working to build a dock four miles from the port called the southern california internet gateway or skig eliminating use of the i-10 freeway. our limits to build this have been challenged by local opposition groups and permit is tied up in the courts. we think that project will create operational efficiencies for the ports. west coast ports are facing challenges duing to congress and growing freight concerns are not the whole story since freight have not returned to levels since seen before the recession. there are several factors that are contributeingcontributing, including inadequate port infrastructure needed to handle the larger ships, limited infrastructure adjacent to the ports. operating restrictions from local communities and operating operatingin efficiencies but the most disruptive to the supply chain is a reduction of the productivity as a result of the negotiations between the port and imla. it has declined by more tha

bnsf there was a guy who got married as has been asked for health insurance, didn't get it, filed suiting if i were married to a woman i would get health insurance. the employer put in its brief the classic like of sex orientation is not covered under title vii. this is a sex orientation claim. and the court denied summary judgment instead i'm reading the claim, reading the complaint and it says if i were a man raped a woman i would get health insurance. i'm a man married to a man and so i don't. and that's sexist omission. andand the court actions that i was a senior about sexual orientation. now, there was an immediate sexual orientation because, but, of course, right? it's just now i think now the social norms have changed, the legal logic was always there. but now that social logic has changed, and in a way social logic, cultural logic had to change before legal logic could prevail and courts could actually see the words in front of them. so last piece because i want to leave time for questions. let me conclude with this. 50 years ago congress passed titletitle vii of the sub right

fwloo your companies like norfolk southern kansas city southern, bnsf and that's really because it hasst efficient to implement a combination of train and truck rather than just moving your cargo across the country exclusively by truck over the road. when you bring rail into the equation, you can actually haul more goods, more of these containers over the rail and when energy prices are high it's a much more fuel efficient method to use train to do the majority of that haul. that being said the industry's trade association is expecting similarly strong growth for this business this year. again, looking at potentially 5% growth, but there are three factors that analysts are watching and watching very closely to see whether that happens. to see whether fuel prices continue to come off because if fuel prices come off all of a sudden the cost of trucking becomes over longer distances becomes more attractive versus this mooed of transportation. the second all that congest wron weave seen in the west port that's had ripple effects throughout the country, even here in cap can city and the thi

on bnsf because in the letter you did seem to be so disappointed, what do you think the screwup was?ondarily given all of what you are going to spend, is there a way to measure what return you're going to get on that capital? >> well we have to spend the capital whether we get a return or not because we've got an obligation on service. the history would be that we would get decent returns. and the railroad business is a good business. it wasn't for a long time. it's like the chicago cubs. had a bad century. but then it's really improved dramatically since the act 30 years ago by every measurement. and it's a very decent business. it's very capital intensive. but obviously if you had your entire system double tracked, you'd have a whole lot fewer problems than if you were single tracked. and there are all other kinds of variables. the big thing i think over the next ten years that's going to be a real problem for the industry is chicago. because the rail system you know was designed 150 years ago, gets modified all the time. but chicago is where everything went. and things got switche
