this week at the full board hearing, board president chu and supervisor farrell introduced amendments for their districts that would not permit the extension of hours beyond 10:00 for several commercial districts. supervisor farrell also amended the ordinance to get a noticing provision where interested parties could opt in and be notified but future permit requests if they wish. the board passed the ordinance on the first reading. this week, the board also established their own response to the civil grand jury. i know you will be considering that later today as one of your items. the board this week approved the resolution the disagreed with the civil grand jury on their findings 1 through 5. they incorporated the other responses as their own. this resolution was adopted with a 6-5 vote. we have an appeal of the document for 1945. on june 16, you heard a discretionary review on the related project to convert a parking garage into a three- story residential building with 17 parking spaces and some commercial space. at the hearing, you modify the product and included additional setback

[applause] they were all the members of the budget committee. but again, i want to thank each and every one of the members of the board, because we worked really hard. at the beginning, in january of this year, we all faced a $380 million deficit, and we all went to work. particularly, our office had to lead. like i say, we were on first base. and i wanted to thank so many other parties in this great city of ours for coming together. because the board of supervisors and the mayor's office, we knew we could not do this alone. the city budget reflects so many values of our great city. whether it is departments or community-based agencies or whether it is neighborhood groups, we all had to put our focus on and make sure that this budget would be balanced in the right way. so i want to especially thank all of our labor unions in the city for coming t

we would ask that the board memorialize this. secondly, we ask the board to order the removal, and there is a number of reasons for this. it is without question that this new window was installed without a permit and replaced in 2005 with a new window and moved above the edge of the appellant's roof. it made contact flush with our roof a significant noise from this window and directly into the corner of the appellant's house. access is obtained by the neighboring tenant and left on the appellate's roof. we voiced concern in january of 2007, but nothing has been done to alleviate this issue. it is our relief that it is a and violation of the building code and code of regulations. that specifies that openings in exterior walls have to comply which indicates that an alteration of an existing window on another property line which is clearly what we have here what violate the california code of regulations that require the alterations chow comply with the requirements of the code of new construction. you could not have a window there.

i would welcome him to go to the board of supervisors to make his pitch to the board. i believe the majority, if not all of the board of supervisors, will end up endorsing our proposal. we will have a public process for him to involve himself. i had offered his input. we took a lot of his ideas at the beginning in january, february, march, when we included everyone at the table, and he was still out that gathering signatures for something different, using outside money and outside help. we were all working with the city family, labor unions, city departments, trying to do our work. so his proposal has not really changed. i think he is just realizing the data is coming and he is a ploy to have to make a decision whether to go with hours or himself. i do not that there is much support for his proposal. he has not that it the right way. we continue offering him eight opportunity to join us. he will attack our proposal with limited few points that are not correct. he is currently saying that we made some deal using the budget balancing proposal. that is so nonsensical. he
