we recommend the health service system, the health service board and board of supervisors legislative analyst recommend approval for 2014 benefits. we think we should realize this really impressive renewal of 2.4 percent increase. we believe that it is important for all of us to preserve the continuity of care and avoid disruption of services for the kaiser enrollees in the package. we have a deadline guideline for the enrollment period which requires the rate package to be an approved. we are engaging kaiser for a plan for 2015. lastly we did want to discuss the implications for not approving the rates. they are substantial and not immediately evidence. to exclude kaiser and not approve this rate package and ask the board to create a new rate package for you with or without kaiser in it, it will take until august 20, to complete. to get through the organization, health organization board and the legislative analyst review. we would be looking at august 20th before we can bring you back a new rate package. in addition if kaiser were excluded we were would basically have blue shield an

the board of appeals, i was a member of the board of appeals for four years and i don't think that that process necessarily fits the kind of decision making that is required in this case. in the first place, i'm not sure that if you appealed a building permit that you could appeal the building permit on the reason that the environmental review officer may or may not have had -- made the right decision because in the past, at least yesterday's hearing before the hpc, it was said that this was -- well, i don't remember exactly how that went. the other point about the board of appeals is that appeal can be made toward the end of the project. so, if you're saying this is an appeal mechanism that should be used instead of the one that's being proposed by supervisor kim and chiu, then we are into a delay situation, i think. and i don't know how supervisor wiener would feel about that, but in this case we're saying that, okay, there is an appeal mechanism. it's through the board of appeals. you can do it through the building permit. so, the building permit, the final building permit isn't issu

the board upheld that permit. there was also the first appeal of a park let, and that was at 39 30 to 39 40 judah street, [speaker not understood]. the board ultimately upheld this permit, but there were issues and concerns about concentration of park lets. this would be the third one within two blocks. there are some on the other side of judah on the next block down. there are also concerns about the loss of parking and impact on deliveries and whether or not there will be increased double parking there. i think paul of our department staff [speaker not understood] and he presented at the board of appeals and answered their questions, but they did uphold that park let permit. and two other items, one was a letter of determination i issued for 2101 mariposa, for the slovenian hall, a legal nonconforming use of the venue, but it also requested that there was an existing legal nonconforming use in terms of the commercial kitchen. and that it could be used for food production not related to the operation of the hall.

i want to thank you for attending the board meetings and all the members of the board of supervisors. this is the first time the board of supervisors has stepped up and learned about how complex our rates are. as you know, with health care reform they have only been made more complex. i'm very proud of the rate package before you today. it represents the 2 years of work in the county care and represents your decision to take on risk by flex funding blue shield which has kept the rates down. i think it's important to point out that the city's cost are only increasing by 0.7 percent. i think anyone would jump for this increase rate in the country. for employers when you include vision and dental, their rate is higher because they have few people in kaiser actually. their's is 2.3 percent. still lower than the national average, lower than calipers and saving the city tense of millions of dollars over the years and as well as saving our liability. i want to recognize as the supervisor ferrel, elisa, when i got diagnosed stepped up and has been running as fast as she can. we wouldn't have

the board of appeals posted. we honestly believed that we did not need to respond to this letter signed in the manner prescribed in order to strengthen our case for gaining a fair and realistic timeframe given our individual and special needs of a one year eviction notice, a time frame by the way that has always been promised to buy our landlord adil shaikh. by not responding to this notice, -- who in the past had successfully assisted us with an illegal eviction from a prior landlord. after the window timeframe for responding to the notices had expired on may 25th, we received two eviction notices signed from mr. shaik. we were told at that time that because we had not responded to the notices in time, they could not be of service to us. we feel we lost a valuable ally in this process. so it's been proven in the past to help us. why again did we not respond to the notice? the sign posted in part reads any person who deems his interest or property shall be affected by work performed. to us that phrase is crucial.

three members of our board of supervisors spent an extraordinary amount of their personal time as well as their city time to get this done. board president david chiu, supervisor mark farrell, and supervisor david campos spent an extraordinary amount of hours and i personally want to thank them for doing that because i know that those early morning hour meetings that occurred, the weekend phone calls, sometimes the phone calls were from lou to get them back to the table after some doors were slammed. and we know that because i've been through that myself. yet i would say that dedication and leadership persevered through our supervisors, and they made it happen. this could not have happened without a local businessman's participation as well, and of course i'm speaking about lou girardo. he agreed to serve as a mediator, gave a huge amount of his personal time to this effort. and while i know he didn't realize what this would take when he first volunteered after we asked him, i also know that he worked through a lot of frustration to get this agreement happen. and it wasn't just the mee
