bob redell arrived on scene. bob, it looks like you're not alone out there. >> reporter: good morning, marla. the water main is at terrell elementary. that's the school's main water supply. the san jose water company has shut off the water, as you can see. the question now is will terrell elementary be able to get the water fixed in time for class today. if they're not able to get it fixed in time, will there be class? >> we haven't been able to reach out to the school district and we're not sure if they're aware what happened. you can see the vehicle, the lincoln town car was speeding down pearl avenue. police believe that the driver might have been drunk. that car collided with another car carrier that was trying to cross the street. and when it collided, you can see it came up here onto the sidewalk and knocked out the water main supply. the driver of the car carrier is fine, but there were three people in the lincoln town car. two of them, a man and a won ma, both fled initially. but police found them, and the

bob redell is live where we'll get an update on the efforts in about an hour. >> good morning. can you hear me? >> go ahead, bob. >> reporter: spoke with cal fire and they said they are not going to do the 6:00 a.m. update. so here is the update. give you an update. yesterday morning at this time the morgan fire had burned 1500 acres, by yesterday afternoon, 3700 acres. here's the update. then the fire's growth has stopped. last night the fire had not groep. this is in part because of the wind changed direction forcing the fire to blow back in on itself and because of the work of firefighters. there are 700 of them who have been cutting firelines. so they are gives themselves a pat on the back they have been able to stop the forward progress. containment is just at 20%, that number has not increased overnight. but again, the good news is that the fire has stopped progressing, it's not grown in size. it's burning in on itself. the morgan fire, firefighters have been able to protect the building and beacon along the communication equipment at the summit of mt. diablo and many road

bob redell live outside the team headquarters in santa clara with a story only on nbc bay area. good morning. >> reporter: good morning. a story uncovered by nbc bay area's investigative unit. a civil lawsuit filed tuesday here in santa clara county makes strong accusations against aldon smith and former 49 and current titan delaney walker. the plaintiff, esporlas claim his was shot twice, sustains serious and permits injuries but does not know exactly who the gun man was. this is the first public document to provide details of a party that took place june 29th last year up this road in the east san jose foothills at smith's 8,000-square foot home. the lawsuit says smith and walker, who were legally intoxicated, appeared on the balcony of smith's home and fired shots into the air in an apparent attempt to end the party. it goes on to say walker made his way to the driveway where he allegedly fired more shots into the air and towards others attending the party. the suit also claims both men knew the handguns were illegally possessed. nbc bay area cob tained pictures from neighbor

. >> bob redell is live at the staging area for firefighters. bob, you're on scene. what are you seeing, hearing? >> reporter: well, good morning to you, jon, laura. right now we're in clayton looking south at mt. diablo. you can see the fire continues to burn giving off that glow in this early morning dark sky. it is now burning up at the peak of mt. diablo where the old lookout building and beacon light are. we spoke with cal fire, they tell us they do not think the fire will damage or destroy that structure because there's a pretty big parking lot that separates it from the wildlands and they have enough resources to protect. the fire did grow overnight, almost doubled in size. yesterday the fire had burned 800 acres, right now it's at 1,500. still threatening 100 homes. it's only 10% contained. there are 300 firefighters on the scene. i spoke with the battalion chief. they ordered a lot more resources, as many as 300 more firefighters expected to come in as well as more engines, dozers and at 8:00 they will have more aircraft to dump water and retardant. they hop

bob redell is at police headquarters there. investigators, they have any idea on motive? >> reporter: looking at possibly road rage, possibly gang related. those are two theories they are working on. good morning. this started before 1:30 this morning when police received a 911 call from three people in a red subcompact, driving down university avenue to say they were being followed closely by people 18 white camry. as police were heading out to respond they could hear six gun shots. then the shots happened on the university of michigan about a quarter mile from the police station where i'm at. police found the red car, rear window shattered down university, closer to 101. three passengers on the side of the road a. driver was grazed in the arm, the 18-year-old girl who lives here in town was sitting in the back of the car, she was grazed in the left arm, the passenger up front was not hit at all. >> i can't even say if it's gang related. i can't say if it was road rage. leading up to it they didn't say anything about any sort of dispute or argument between the parties in

nbc bay area's bob redell joins us from the scene, on the phone now. and bob, this just appears to be simply a tragic accident. >> reporter: good morning, marla. chp still investigating the exact circumstances, but from what they know so far, they do not anticipate charges against the driver of the suv that ran over this body. in other words, they might determine that this was, as you mentioned, just a horrible accident. this happened a little bit before 8:00 this morning on byron highway. this is right in front of excelsior middle school. a mother driving a black gmc yukon had just dropped off her children who attended excelsior. he was making a right-hand turn out of the school's driveway when she ran over what she thought was a ball. she drove another 50 feet or so, pulled over to the side of the road to find out what was under her vehicle, and to her horror, she realized she had hit, run over, and dragged a 12-year-old boy who had been riding his bicycle. chp says he was pronounced dead at the scene, that he was still wearing his bicycle helmet with

bob redell is live in los gatos with the latest on this heated debate. good morning. >> reporter: good morning. correct, the los gatos council enacting these rule this is week which affect gun shop owners like templar sports. they just moved in nine months ago now can stop selling guns or move. across the street if it wants.yñ it cannot be at this location because it's within 250 feet of places geared toward children. across the street is apparently okay. it was this week the same week as the mass shooting in washington, d.c. that the city council passed new laws for gun shops. these kind of businesses must now apply for an annual permit, and as mentioned before must be at least 250 feet away from places like schools, church, parks, government buildings and businesses that are geared toward children. the city took up this issue about nine months ago, this is when residents started protesting the opening of templar sports. it was in december after the mass shooting in newwn, connecticut. people felt blind sided by the opening of templar sports, that it's

"today in the bay's" bob redell is live on the scene and has the latest details. good morning, jon. a horrible hit-and-run accident that killed two women. police, as you mentioned, are still looking for the driver of the silver mercedes. one of two vehicles involved in this accident. happened around 3:20 this morning. investigators trying to figure out who is at fault. they know the two women in the total yaris were making a left-hand turn off north first when they collided with the mercedes that is heading down. they still don't know who had the right-of-way. one woman didn't survive long enough to make to it the hospital and was declared dead at the scene. the other woman was taken to the hospital bhu also died. one thing they will be doing, obviously checking the registration of that silver mercedes, following up with that and also trying to keep an eye out, if anyone were to show up at a local hospital with this crash to see if maybe that is that person here. again, hit-and-run around 3:20 this morning, not far from norm mineta. two women killed. the driver of
