today in the bay's bob redell joins us live from the hall of justice in san jose. this morning's hearing comes after a court recently overturned dana stubblefield's rape conviction. you are correct. good morning to you, lawrence scott. later this morning at 9:00, a judge here at santa clara county superior court behind me will hold this hearing to release. that's where the lawyer for dana stubblefield will petition the judge to try to get the judge to agree to release his client from prison, as you mentioned. last week, a california appellate court overturned the 2020 rape conviction of stubblefield. he used to be a defensive tackle for the san francisco 49ers and the then oakland raiders in july of 2020. dana stubblefield was sentenced to 15 years to life in prison after being convicted of raping a woman who was interviewing for a babysitting job at his morgan hill home. a california appellate court determined that stubblefield did not get a fair trial, and prosecutors violated the 2020 racial justice act by making racially biased comments about him being black. t

today in the bay's bob redell joins us from an area close to coyote creek in san jose. bob. clearing starting to starting today. right? not necessarily. what's happening is because we're in the new year, the santa clara valley water district can begin enforcing a law that bans encampments on valley water land like the area behind me. i know it's dark out, but there's an embankment behind me down to coyote creek. there are a number of people who are encamped out here. this, of course, is near story road. what used to be the jungle here in san jose. if you're familiar, you've been here long enough to remember that the city of san jose has said these encampments are spilling waste into local waterways and need to go in order to be in compliance. the encampments need to go away in order to be in compliance with the clean water act. a spokesman for valley water says the district is right now not planning to remove any unhoused people by force from the embankments of their waterways, but instead will conduct public outreach to try to give the people options on where they could go

i'm bob redell here in san jose.g today, the santa clara valley water district can start enforcing a new law that bans encampments along its waterways. like the area behind me here near coyote creek and story road in san jose. the city of san jose has said these encampments are spilling waste into our local waterways and need to go. the encampments need to go away in order to be in compliance with the clean water act. a spokesperson for valley water says the district is right now not planning to remove any unhoused people by force from the banks of its waterways, but instead will conduct public outreach. one person is dead following a head on crash northeast of gilroy. the chp says around 730 last night, a truck and an suv rammed into each other on leavesley road near new avenue. a third car was also involved, ended up in a ditch. officers closed both lanes of leavesley for about two hours to collect evidence and for crews to clear the roadway. it is now back open. it's another cold start on this thursday morning. cy
