so what bp is now adapting is what the bp spill commission recommended. should the rest of the industry also happened to comply with that same standard. >> mr. markey, we welcome any efforts by con days to voluntarily enhance the standard they impose on themselves. as you know, we put a lot of effort immediately after deepwater horizon into raising the bar for the industry through a new drilling safety regulations and three safety management regulation. and i've said since then that we are going to further add to those regulations are a normal notice and comment rulemaking process that will take some time generally does and we are continued to make that god and far-reaching, but not at the emergency lickety-split pays that we impose the initial rules. now certainly, specifics that bp is voluntarily signed up to may be among the additional to the embrace. it is to early to know. but i do want to emphasize the standards are not in lieu of our overall standards that were heightened last fall that will impose on bp. >> are the standards higher than your post?

bp writes the check.the responsible party pays, and that's where when we talk about the division of labor, it is driven from the federal down in holding the responsible party accountable, and if the responsible party fails to fund that, then we fund that out of the oil spill reliability trust fund. that's the process in place. when i looked at the most critical gaps, it was offshore skimming capability. we reached out to norway and the skimming capabilities they used in the north sea to get that skimming equipment to the gulf coast, not by vees vessel, but on a heavy lift on to an osv into the gulf of mexico. we invoked over 60 foreign offers of assistance where there's critical gaps that needed to be closed. there is a waiver procedure under the jones act, and at no time did the jones act impede the resources that we needed to respond to this unprecedented spill. >> it's your testimony that the jones agent was not a problem -- the jones act was not a problem getting the skimmers in? >> correct. it was in

somewhat of a kinder picture at bp. they've announced a second quarter profit.t it's still missed analysts' predictions. our john defterios joins us to look at the figures, a company with great past. you might say jammed the day before yesterday. jammed tomorrow? because it says if things get better. but not very much jammed today. >> we're right in the midst of a major restructuring. let's look at the actual number, charles. at $5.6 billion, not bad. but they were expecting revenues on the market of $5.9 billion to $6.1 billion. there was a $17 billion loss last year. selling off u.s. refinery capacity, $25 billion and overall asset sales going forward. there's a statement out to the market today. the stock is down 2.5%. he's suggesting the payback will come in 2012 and 2013 as in terms of the jam in the future. >> let's be clear about this. this isn't just a humbler b.p. this is actually a physically smaller b.p. which is pumping significantly less oil and gas. >> if you look at the output, it's 3.4 barrels a day. it's down 10% because they lost the production

bp is to be commended for coming to the table with their checkbook. it's a very important thing to keep in mind. taken to the table with tourism fund some safood safet marketing funds and we very much appreciate that. i want to paint the box we're in today. as you very well know better than i do come of this country is facing fiscal challenges to read our state is facing fiscal challenges. there's a $1 billion cap on the light of the trust fund to fund the oil spill response activities including $1 billion cap. we are over $900 million of expenses from this disaster s far, and so the only force of money for us in this case is bp. it's the only source of funding to a large degree to fund response, nrda operations. mr. chairman, i think the creation needs to be flipped over. i think the public should be in the driver's seat by being able to control check but you can control what is in the work plans, how the nrda assessments are conducted. the timeline of the assessment perhaps losing access to the data because of the negotiations on going with fees' wo

the oil rig that started the drilling at the bp's failed well was not the bp horizon. that well ended up running into trouble about a month into the job. it had to be moved away for repairs and only then was bp forced to bring in a replacement. the replacement rig they brought in was the deepwater horizon. the deepwater horizon drilled for about two months before it catastrophically blew up. the deepwater horizon was a replacement rig. the rig that was originally slated to be there, the rig that was supposed to be the one drilling that macondo well was the transocean marianas rig. it was supposed to move off the coast when the crew discovered it was taking on water at an alarming rate. the crew was evacuated immediately. only a skeleton crew was left on trying to save the rig. they say the marianis rig has been stabilized and they're working on towing it to a location where they can inspect the damage. after the deepwater blowout last year, they retained documents about safety concerns nsds the company. one of the things they found was that on this particular rig, 61%
