let's kick off with bp. it's raised its dividends for the first time since the gulf of mexico oil spill after beating expectations in the fourth quarter. wayne bischoff joins us now. there was a time we didn't get a dividend out of bp, wayne. how much good news is this? >> it's probably the best news out of all of these numbers today, bringing the dividend yield back to 4%. there is a degree of normality of what expected. the market is generally pleased with this. and here it can go along with bob dudley's phrase turning point as being a good sign there is a return to normalcy for bp. >> they couldn't close a deal in russia. what is the strategy? what does this company offer future shareholders? >> it's trying to move more and more through. they're planning to increase their operations, planning to sort of try and find more. they know that at the end of the day you have to get the stuff out of the ground. you have to find the stuff, find the reserves. think back to how bg has performed, finding those reserve

bp does not have a run away jury verdict to fear.oil joint does have great motivation to settle anyway. >> bp would like to get this off the front pages of the newspapers. they would like to -- bp wants to continue drilling in the gulf therefore they would like to make their peace with the government concerning the civil penalties. >> the speculation here is that perhaps bp could settle this week. this has nothing to do with the criminal case still spending. >> shepard: phil keating thanks. white house is getting behind revamped proposal to expand the keystone pipeline. it's the shorter version of the contested transcanada pipeline and it avoids the environmentally sensitive sand hills of nebraska. you may remember that was a key sticking point for the white house in partisan battle over the project. instead of starting in canada, this pipeline will go or would from curbing oklahoma to the texas gulf coast. at least for now. since that portion would not cross the border it doesn't need federal approval. here is the white house press

a federal judge delayed the civil trial over the bp gulf oil spill by a week. the trial had been scheduled to start today in new orleans but the judge says bp is making progress in settlement talks with a committee that's overseeing thousands of lawsuits. the trial will determine the amount of damages bp and other companies must pay for the worst offshore oil spill in american history. speaking of american, american airlines is warning its unions that it needs to take -- make big changes to its labor contracts and do it quickly to achieve the cost savings to successfully make it through bankruptcy. american which filed for bankruptcy protection rejected proposals by two unions to offer buy-out packages, the carrier plans to cut about 13,000 people or 5% of its work force so a major change coming for american airlines if they stay in business. back to you. >> thank you very much, brian. >> it is 4:44 now. let's talk to meteorologist christina loren to find out what kind of weather we can expect. it was so good last week. tapering off. >> yeah, well, this is the

department of justice and bp are set to begin in court. the mess they made. of the $20 billion they set aside to pay people whose livelihoods were destroyed by the spill, only $6.5 billion have been allocated. the rest of the money can go to the u.s. treasury. really? are we that convinced we have seen the last of the economic damage done by the spill? up in alaska, fishermen are still trying to cover from the exxon valdez spill. if you add up the liability in court, it's anywhere from $5 to $21 billion in civil and criminal penalties. plus by their own estimate in court documents, up to $42 billion in cleanup costs and economic restoration. let me get this straight. only $6.5 billion have been spent on actually helping people in the bufl. that's out of $20 billion set aside and another $63 billion in legal liabilities. by my math, that's 8% of total funds actually going to cleaning up the mess. or just under bp's profits per quarter. talk about getting off easy. here's some advice for my fellow lawyers at the department of justice. don't

let's start out with bp. this company just reported its latest set of earnings about an hour or so ago. they're much better than people had been expecting. the company's fourth quarter profit rose 15% to $5 billion. bp also raised its dividend pay o out14% a share to a total of 8 cents per share. it's time to talk about the commodities traded glencore and the mining giant extrata. investors don't seem to be reacting too well following the announcement of that deal. we'll have more on the fine tuning going on coming up later on in the show. we have losses that are rather muted with the lowering of the frankfurt dax. this is largely because greek lawmakers have yet to reach an agreement on those harsh austerity measures that are required as part of the next bailout money greece will be getting. they were supposed to meet again yesterday but postponed that meeting yet again, andrew. this is weighing on the xetra dax and the cac currant in paris. these banks are exposed to what's going on in greece. >> we'll find
