nbc10 news. >> as randy told us the brandon tate-brown shooting happened in december. philadelphia police pulled him over in mayfair. today, the district attorney show showed police struggling with him and photos of the gun inside the car he was driving. tate-brown's family members say they want all the evidence released to the public and say they plan to file a civil lawsuit. >>> philadelphia police have two teenagers in custody. they say a 15-year-old killer is still on the run. they're looking for the shooter in this case of a father who was murdered while walking his dog last week. detectives released his picture today. he is a freshman at overbrook hool. high school. he and two other teenagers wanted to rob someone last week in overbrook. they went after this man who was walking his dog because he looked like an easy target. >> they pulled a gun on him. he instantly turned. they said empty your pockets. he tried to reach out for them whatever a real slight struggle and ultimately they shot him one time. >> police arrested 15-year-old brandon smith and charged him

brandon tate brown's attempt to get his illegal gun. this not just because the police said so but because the facts were confirmed by the contemporaneous accounts of several civilian eyewitnesses. by video, by physical evidence and by dna testing. the witnesses didn't know each other. they had different advantage points and gave statements almost immediately after the incident. on the early morning of december 15th, at about 2:45 a.m. mr. brandon tate brown was driving on frankfurt avenue in the mayfair section of our city. he was driving with his daytime running lights on but not his headlights. we have video showing the car. police signaled him to pull over and he did. mr. gillisen. after the police approached the car, one on each side one of them saw a gun between the passenger seat and the console. the gun was recovered there immediately after shooting and photographed. dna testing of the gun was positive for mr. brandon tate brown. now, this is a very difficult car stop scenario. the officer indicated to his partner that there was
