that night brandon went to the emergency room. the medical report from that evening states that he had pneumonia and a white area inside his mouth that appeared to be peeling. and my brother went home and he put on facebook that he was scared to go to sleep. and he didn't wake up the next day. brandon's autopsy report found that he had non-toxic doses of methadone and an anti-depressant in his system. it attributed his death to a combination of a drug overdose and pneumonia. despite the autopsy report brandon's family believes that his death was work-related. >> what do you think killed him? >> i think it was the chemicals. i've never seen anybody's throat swell up or their whole entire face swell up the way that his did. >> osha issued the company a citation for failing to test the space for hazardous atmospheric conditions and another for failing to train their employees. >> the company wasn't doing atmospheric testing. this is the very beginning of the safety program especially with regards to confined space. you gotta know wha

. >> who killed brandon -- >> this was the scene outside the criminal justice center in center city this morning. ten people were set to be tried here after they were arrested last month while protesting the death of brandon tate brown. officers arrested all ten after they interrupted a community policing meeting in long crest. the protesters were angry over the decision not to name or prosecute the officers involved in the death of brandon tate brown. police shot and killed tate-brown last december after pulling him over in mayfair. the district attorney ruled tate-brown did not follow officers' orders and was reaching for a gun when officers shot him. a judge today granted the prosecution's request to delay the trial of the ten protesters and defense lawyers were not pleased considering their clients and witnesses had taken off work to come to court. >> skeptical motivation at the district attorney's office for trying to continue the case today and for trying to do it at the very last minute. when the primary witness is standing right there next to the prosecutor and known about the ca
