i think brett kavanaugh in his time on the d.c.ircuit judge -- and even in the hints we get in some of his opinions and has taken it up as well. just to kind of pick up on here. justice gorsuch in his dissent, it's just a lambasting of retaining this deference doctrine. a bare majority flinches, and our lives on. today's decision is more a stay of execution than a pardon. he calls it a fantasy, a paper, linguistic hocus-pocus, no more than an exercise of raw political executive power. secret intentions are not the law. just in case anybody thought that there was any conclusion -- confusion about where he stood on this thing. both of these cases more broadly indicate a real tectonic shift going on in the court, probably one that was started by scalia , but hadn't taken much route as it seems to have. justice kagan famously said we are all originalists now. i think we are seeing is a revival of textualism of not just the kind of raw text that what the actual original meaning of the text was. and that the text controls more broadly. s
