brian remains in a coma here at san francisco general. lead suspect in the case, giovanni ramirez could be a free man today. here's why. the 51-year-old ramirez will be in court in los angeles where a judge will decide to keep him in custody or let him go. ramirez was arrested in may in connection to the stow beating. when ramirez was arrested, a gun was found in the house, a violation of his parole. ramirez is on parole for a 2005 arrest. but ramirez's defense says the los angeles police department doesn't have sufficient evidence to link ramirez to the beating. the defense launched a very public and very aggressive campaign to prove ramirez's innocence. to begin with, they say surveillance video from a hotel and gas station showed that ramirez had a full head of hair, though the suspect is a man with a shaved head. the defense says that the gun found doesn't belong to ramirez. >> the state has to show that giovanni ramirez had knowledge that there was a gun in the household, which he did not. >> the state can show that it's just possibl
