brian floor brian floor -- brian flores is live with whether the security guard will face charges. >> reporter: when we spoke to san jose police this morning, they told us it doesn't appear that the security guard will be facing charges. but that's still pending a decision by the santa clara county district attorney general's office. weiss still being questioned at this hour. apparently he was on his way home, and saw car burglars trying to steal his dad's car at the apartments off coleman road. he confronted one of the suspects face to face tried to physically detain him. but the suspect got away in another car with three others. that car sped away almost hitting the security guard but searkds later, it stopped. one of the suspects came out, he was going to pull something from his waistband, that's what the police said, and the security guard opened fire. >> if he felt like his life was in danger, he was probably well within his right rights -- rights. >> reporter: a man whose older sister who lives at the senior apartments say they heard at least five single gunshots last night. >>

brian flores just spoke to police and join us live. what are they saying? >> reporter: no question, a very violent weekend in oakland. three people killed here in oakland. nine others injured. but police announced a few minutes ago they've made an arrest in one of those shootings. take a look at the map first. details where the shootings took place. four people were shot friday night two of which died. then on saturday, one person was shot before 11:00 a.m. four people were shot in a nail salon and another person was shot saturday night. oakland police have made an arrest on a quadruple shooting that injured four people -- that happened saturday afternoon around 4:00. this was a suspect who broke into a car off telegraph and was chased by witnesses. that suspect came back and opened fire and injured four people. police say as soon as they knew who it was, they were able to make an arrest quickly. >> we made an arrest late last night. this is due to a patrol officer, as soon as investigators learned who was responsible for the shoot, they immediately put the

ktvu channel 2 reporter brian flores is live for us in alameda with what's been a very busy morning fork right there right now? >> reporter: well, it's looking pretty good. a lot of people taking it easy. not standing in line. in fact, sitting down at the benches because the lines are moving quickly here on the ferry system. not to say that we haven't seen long lines. it's nothing compared to what we saw during the b.a.r.t. strike. the only thing i would really say, the parking, officials say most of the lots are close to being full or are full already. some commuters park their car on a dirt lot. i just got off the phone, got another update with ernest sanchez. he says things have been running smoothly. as of 8:00 they've had 21 departures from the terminals. a 6:30 ferry boat marked out at 330 passengers. about ten passengers were left behind to catch the next ferry that left at 7:00 this morning. the san francisco bay ferry says they will be running 11 boats taking commuters to san francisco and vice versa. on a normal service there would be eight boats. some say they are looking for

brian flores is there now. you can tell us what happened. ing, brian. >> good morning, dave. still working to piece together exactly what happened. as you can see, san francisco police blocking off the area around turk and taylor this morning. san francisco police say they are going to be here for time as they continue to investigate. what we do know so far, at least one man was shot here on turk here in san francisco. from what we understand, we may have been shot once, maybe twice. he was shot in the leg as well. san francisco police sources say at this point the man has nonlife threatening injuries. he was shot in the leg and taken to the hospital. what remains unclear is whether a person was taken away, a suspect. we have seen many officers, detectives here on scene questioning several people, perhaps witnesses. but we do not know if a person or a suspect was taken away. i can say the area on turk and taylor is closed off for the shooting investigation that happened around 630 tomb :30. there is a lieutenant on scene. we will pass on any

ktvu brian flores is joining us live. he is where holder will make that announcement.orning. >> reporter: good morning, dave. this has to deal with reducing the prison population which is way over crowded. not only in the state but throughout the country. holder will be making that announcement here at the american bar association annual meeting that is being held at 10:00 this morning. he will be the keynote speaker. low level offenders will not get high prison sentences. changes also include diverting low level drug offenders to treatment programs along with expanding an early treatment program. holder is also asking 94 u.s. country across the now the justice department believes this is one way to reduce the prison population. one figure we are showing is that federal prisons are operating at 40% capacity and costing the country $80 billion to run the prisons. holder is expected to travel across the country to promote this plan. live in san francisco i'm brian flores. >>> in san jose family members and friends of the victims of a deadly weekend car crash are planning

brian flores is live at the moscone center where holder will make that announcement today. od morning. the basis of this whole thing is because it wants to reduce the state and the federal prison system overcrowding in the system. we all know that the prison system is heavily overcrowded, not just here in the state buttate across the country. eric holder expected to make the announcement at the american bar association. he will be the keynote speaker. he's expected to announce that under a proposed drug policy, nonviolent or low-level drug offenders won't get severe prison sentences. instead, will get shorter sentences or sometimes no jail at time. the offenders must not be tied to gang or large-scale drug organizations. we've spoke with some attorneys who are attending the conference this morning who say this plan is long overdue. >> we need to restrict the prison system to shows folks that really need it and find treatment for people that need treatment. >> reporter: the justice department believes this is one way to reduce the prison population. federal prisons are operat

brian flores has been following all of this. is in our newsroom with more details on what we know now. >> reporter: the latest we are hearing the ntsb is investigating the cash. they are about to send a go team to the area to investigate. at this hour crews continue to battle flames as a result of this crash. the ntsb says it's an a-306 cargo plane. this crash happened before dawn this morning. the plane was flying from louisville, kentucky to birmingham. there is no word on any injuries. as you mentioned there are several reports indicating the pilot and co-pilot are now dead. birmingham mayor says the pilot and co-pilot were the only people on board at the time. many residents remember hearing two large explosions. reports from the ground indicate the plane landed in an open field. it is also being reported that the wreckage is spread throughout a distance of a half a mile. we also understand that ntsb will be holding a press conference around 6:15 our time to give us the very latest information. of course we will keep you upda

ktvu's brian flores is already there. you have an update on what the police are doing. brian? good morning, dave. yeah. berkeley police back out here this morning. investigators are combing the area talking to residents and businesses asking people what they saw or heard last night. but from what people are telling us, they say crime is on the rise here especially in this part of berkeley. this is normally a safe neighborhood which is why many are left wondering what's going on. this morning, police have not released a suspect description at this point. but police do say the shooting happened just after 9:15 last night near bing's liquor store. police received reports of multiple gunshots heard in the area. when they arrived, they found a man lying on the street injured. police have not released his identity but they say he was 24 years old. that man was then returned to a -- then rushed to a nearby hospital where he died a short time later. this is berkeley's second homicide in the same area in the past two weeks and third over-- overall this year. one resident said he heard

ktvu's brian flores is in berkeley now, where the building has been given a reprieve even though it maygoing on, brian? >> reporter: well, that's for now, dave. good morning to you. many people with the group citizens to save the berkeley post office received good news recently and have been camped out since last month. the news that the historic building will be spared comes as good news for many. it's a small victory, there say. but they are -- they say. but they are not celebrating. the news is they've agreed to hear tom bates's appeal that it should be saved. with the hear, the building that's been here since 1914 will at peest be spared for a couple of months until the mayor speaks in front of the commission in september or october. the "chronicle" reports that he has until september 3rd to submit paperwork about why this is the best location to operate. the issue has always been cutting costs and selling post offices, even this one, are needed to keep the post office afloat. the group says the post office means a lot and keeping it here is still a battle. >> it's great to have a c

ktvu brian flores is live at oakland police. department headquarters with the advice being offered. brian. >> reporter: you and dave know what this goes through. oakland police sent out tips for kids and parents that were heading back to school today. they say safety should always be a top concern. through their community e-mail service opd sent out a tips for kids to be safe. it's important to map out a safe route for their kids. they also say to identify safe houses in the neighborhood so your kids know where to go in case of an emergency away from home. when it comes to bus safety opd says it's important to teach your kids to arrive five minutes early. making sure the bus driver sees them before crossing in front and never walking behind the bus and be aware of bullying on the bus as well. after school police say that your kids should check in with an adult as soon as they get home. establish rules about who can come over. as well as restrict internet usage. and find a trusted neighbor that will allow your kids to come over in case of emergency. kids these days are faced with more

brian flores is live now near the bay bridge toll plaza, and you're going to tell us about some extraommuters, brian. >>> yeah, dave, well, certainly information is the key when it comes to this transition from the old span to the new span, as you take a look behind me, you can see what commuters are facing today and probably what they'll be facing the tuesday after labor day. one of the things will be the infamous s curve and track the traffic conditions in the bay area and they're making it easier and more precise to figure out what it will look like come the labor day weekend. they are working with a washington based company to deliver precise traffic when the bay bridge closes. along with 511 say they will be using crowd sourcing technology to deliver traffic information and they'll get that from car, fleet vehicles, taxi drivers and mobile phones. despite that, some commuters we spoke with this morning say they are not looking forward to what's ahead. >> it's going to be very bad for commuters, the people that go every day in cars. we don't have a choice. >> reporter: now, you ha

ktvu brian flores is in berkeley with what police are now saying about this and people living nearby say this is a pretty safe area. brian. >> reporter: yeah. you are exactly right about that, pam. good morning, to you. unfortunately police have not released a suspect description as police continue to talk with potential witnesses and the shooting happened here on san pablo avenue and delaware streets in berkeley. now if the location sounds familiar, that is because back in february of this year, there was another shooting in the area. for this case though, police say the shooting happened just after 9:15 last night near binges liquor store. police received reports of multiple gunshots heard in the bay area. and when they arrived they found a man lying on the street injured. he was rushed to a nearby hospital where he died a short time later. this is borkly's second homicide in the past two weeks and third overall this year. an employee that works nearby tells us his reaction. >> i came out to the back and heard three bangs. it didn't sound like gunshots at first. when i went outside

brian flores joins us now from berkeley and says the building is being saved at least for now. . >> reporter: for now, that is definitely the key phrase and for many people in this group that are sleeping right now, 20 people have been camped out here since late july. the news comes as welcome news. they'll continue to remain here for some time. the berkeley post office like hundreds of others was seen as a cost cutting measure. the post office says they would have sold the building and rented space nearby. but just when you thought the building's future was in doubt. the u.s. postal regulatory commission came through and agreed to hear berkeley mayor to hear his pitch on why the building should be saved. that for now saves the berkeley post office from being sold as the mayor expects to speak in front of the commission sometime in september or october. the group that's been camped out here citizens to save the post office say they are pleased but worried for its future. >> it's still iffy. everybody is not celebrating but our heart is beating. our heart is at the right moment.

ktvu's brian flores is out there now with more on what happened out there and how that victim is doingrning. brian. >> reporter: hi, dave. good morning. we understand that female victim is expected to be okay. this is where it happened. this home right here on the 1,000 block of bending willow way in pittsburgh. we have been able to confirm through law enforcement sources that the robbery happened late last night. we understand that a woman was inside at the time and perhaps one or two men enters the home from a back window. that woman was pistol-whipped while the men went through the home. we don't know what they got away with or if there was anyone else at home at the time. we did speak to neighbors this morning. they didn't want to speak on camera. from what they tell me through the police department, the men entered the second-story window by possibly stacking up trash cans. the neighbor told me that they went through the kids' room. we don't know the kids' condition at this time. neighbors are shaken up this morning. we understand that the husband of the victim was away from the h

brian flores is there and tells us whether the driver is -- is facing charges. >> reporter: good afternoon, tori. you have cars, bicyclists and trucks in close vicinity of each other in this accident. this is the latest accident. i just got off the phone with the san francisco police department. they say this appears to be an accident. for now, it's still under investigation. the driver will not face any charges. this after a 24-year-old woman they say was kill as she was riding her bicycle on folsom. this is around the same time a boxed truck was trying to make a right turn onto 6th at folsom. police say the driver didn't see the bicyclist and collided near the right rear tire of the truck. >> a bicyclist pulls up from the rear traveling eastbound folsom. as he begins his turn, he says he hears a noise, stops his truck, gets out and see the bicyclist on the road. >> reporter: after she was hit, the victim was taken to san francisco general where she died as a result of her injuries. she has not been identified yet. neither has the driver. we spoke to a bike rider on 6th and folsom this mo

brian flores in our newsroom now with the possibility, brian, the new span could open earlier?> yeah, i just got off the phone with an official who said it's possible the bridge could open earlier perhaps on labor day but they say it depends on the final construction work completed when it closes starting tomorrow night. let's take a look at the old and new spans this morning. you can see the traffic moving on the old span. this time next week we'll be talking about the morning commute and what it is like on the new span, that is, if everything goes as planned. according to caltrans there's a still a lot of work to be done. bay bridge officials will continue to work on things like road deck preparation, lane striping, electrical work and moving barrier rails. the entire span closes tomorrow night at 8:00 p.m. until next tuesday at 5:00 a.m. it's likely it could open before an opening ceremony scheduled monday afternoon. some others hope it opens earlier, too. >> i will pace myself. >> that's one reason why labor day is so important. historicically, the weather has been very goo

brian flores explains why she thinks the federal government needs to do away with a one sized fits all approach to feeding students. >> reporter: school officials call it food insecurity. in alameda county, about 200,000 students have it. >> what's worse, over 40%, competed nutrition program's low income threshold, and cannot qualify. >> reporter: the federal decide for a family of four to qualify is just over $42,000. state and school officials say the cost of living is much higher in the bay area and the state, so the call is for congress to take a more regional look at the cost of living for families. >> we know full well, it is less expensive to provide that same meal, say in the state of florida, or the state of alabama, than it is in california. >> reporter: the assembly member is introducing a legislation, says that at the federal level, congress needs to look at free, and reduced meal programs. she says a one sized fits all formula just doesn't work. >> we have many, where that do not qualify, and yet, their income is not adequate to supply for their families, or their needs. >

brian flores is in the newsroom with the progress they are making this morning. brian?porter: no question they are battling bravely. in terms of progress, the number we're hearing the fire is only at 5% containment. the fire has destroyed at least two homes, is threatening thousands of others. it's also moving closer to yosemite national park. at last check, it was 10 miles away. officials say they are keeping ap eye on it. >> we are concerned, however, it's not a threat at this time. >> it's quite some distance still to get there? >> it is a distance. the fire is a distance from yosemite national park. >> the rim fire has also charred more than 16,000 acres. when we get new numbers, the numbers are expected to increase. the direction of the fire is expected to head north and then east. the use of fix wing aircraft and firefighters will be key. it's expected to spread to the north and the steep terrain is making it difficult to fight the fire. coming in the next hour, we'll explain how fire resources not only battling this fire, but others are running thin. ktvu channel

brian flores has been tracking the wildfire and local aid. good morning. >> we are just entering the fire season down there in southern california. we have dry conditions. high wind with brush or fuel. and creating a fire down there. we want to go to live pictures now. again, aerials of the fire burning out of control. you can see the flames reaching up there. the latest from cal fire is it has grown to 10,000 acres since the fire began. within the first three hours burned acres. and now again 10,000 acres. the silver fire broke out 2:00 p.m. west of palm springs. the fire forced 15,000 people to evacuate. started south of banning which is west of palm springs i should say. at this point 15 buildings have been destroyed. 3 people have been injured including two firefighters and a resident. that resident after sustaining severe burns was airlifted to a hospital. unclear the extent of the injuries. hundreds of homes continue to be threatened. the fire is at zero percent containment. >> it was so smoky, you couldn't see a whole lot. did see flam

ktvu's brian flores joining us live in alameda. how hard would it be to find a seat? one, brian? >> reporter: yeah, if you left now, dave. the earlier the better. things are looking pretty good at the alameda main street ferry terminal right now. when we arrived here about 5:00, 5:10 this morning, there was only one person in line. that number has since increased to maybe about 35 people in line. a lot of people heeding that message to get here early to make sure that they do get a seat and find a parking lot as well which many of them have. the san francisco bay ferry will be running 11 boats this morning taking people from here to san francisco and vice versa. a normal service, there's typically eight ferries that run. san francisco bay ferries expecting a 15% increase during the closure. some riders we're speaking with this morning are saying they're actually surprised there isn't a longer line. >> i'm expecting another busy day, maybe not as busy because our trains are running which is great but i'm surprised that there aren't more people here now. maybe i could ha
