brian todd, cnn, washington. >> brian, thank you so much. >>> joining me now is former boston police commissioner ed davis. great to have you. i want to start there with memphis police pausing the scorpion unit while they do this review process. we know that the family and their attorney has called for it to be disbanded completely. what's your take here? >> thanks for having me, jesse. this is a complicated problem that happens in police departments across the country. i ran into a similar situation in boston with something called operation rolling thunder that i disbanded as soon as i came in. it was named after a military operation. i think chief davis has done an admirable job responding to this incident and holding people accountable and bringing charges against the people who committed these crimes. however, i know memphis, it is a violent city, there's a lot of shooting activity there. something needs to be done. but calling out the scorpion unit is probably not a good idea. it sends a message. and like your last person that commented, this is an abject failure in supervision.

the cnn's brian todd has been all over this story for us. brian, what else are you learning?of the shooting, hours before the shooting occurred we have new information after the warning. disturbing new information tonight indicating there may have been a window of time to prevent first grade teacher abby zerner from being shot by her 6-year-old student. a spokesperson for the newport news, virginia, school district tells cnn that the superintendent george parker said in a virtual town hall meeting that officials at richneck received a tip that the 6-year-old may have had a weapon. parker didn't indicate who gave the tip. of but according to wtkr, parker said after receiving the tip school officials searched the boy's in recent days newport news police chief told cnn the gun had been concealed by the child at some point. >> put it in his backpack and was driven to school by his mother later that morning, and then at some point it came out of his backpack and was concealed on him. >> reporter: the newport news police tell cnn they were not notified of the tip that the boy may h

brian todd has more from newport news. e's imagination. what is the latest? >> reporter: it certainly has, abby. several important questions that this community wants answers to this afternoon. one of them, of course, is how was that child able to obtain the gun at his home and get it into his backpack to bring to school. police say they're still working on that one. talking to investigators, talking to the family trying to determine that answer. but another is, whether this mother could be charged definitively for this incident. you know, possibly as an accessory or anything like that and the chief, steve drew, the police chief steve drew was asked about that earlier today by cnn's poppy harlow. take a listen. >> i wonder if the mother could face charges here. >> so, i think that that is term a possibility. they'll make a decision whether there's charges forthcoming towards the parents. >> reporter: and sorry about that. we also have some other information regarding the police and what they've told us about this case, just

. >> brian: todd piro joins us now with details. >> mother of xana kerr model is devastated over whatte betrayal. she says she was being represented by public defender ann taylor for unrelated drugs charges. on january 5th, the day her daughter's accused killer bryan kohberger appeared before a judge in idaho, taylor officially dropped northington without telling her to represent the 28-year-old. >> i'm heart broken. >> i'm heart broken because i trusted her. she pretended that she was wanting to help he to find out that she is representing him, i can't even convey how betrayed i feel she as active in a facebook group trying to piece together the case. she knows kohberger was a member of that same group. public records show that months before the killings. kohberger applied for a position located just a few miles from the university of idaho and quick legal analysis, guys on this underlying representation issue. it doesn't make a lick of sense, it's a clear conflict of interest. i have no idea how a judge let it get this far and i can't imagine a judge is going to let this go further.

brian todd has been following this for us. he's in newport news for us once again this morning. brian, what does it mean now that school officials are out? >> well, kate, i just corresponded with the newport news police. we have been pressing them on whether charges could be pressed again the parents or school administrators. we don't have any word on that yet. so no word on the administrators or the parents. as the superintendent is now out of air job, the assistant principle here has also resigned and we did get detail yesterday on a time line of three different warningings that according to the attorney for abby zerner, her attorney said there were three different warnings issued here at richnick on the day of the shootings in the hours before the shooting and we could go through the time line with you quickly. according to abby zerner's attorney, at 11:15 she told a school administrator that the boy in question threatened to beat up another child. at 12:30, another teacher told administrators that she had searched the boy's book bag and suspected that he had put the gun in hi

cnn's brian todd has a closer look right now at the days' long standstill. >> reporter: wolf, kevin mccarthyressure to pull this out tonight because congress is paralyzed every hour that he is not seated. [ applause ] the stalemate over kevin mccarthy's house speakership bid has been having a real world impact with crucial business of the country that hasn't been done. >> it's a huge problem because, for example, i sit on the house intelligence committee. we oversee all 19 intelligence agencies. we are currently off line. >> reporter: until a speaker is sworn in, no member of the house can be sworn in. that means throughout this stalemate, key committees have not been able to function including ones that oversee the agencies that guard america's national security. one member complained that since he hadn't been sworn in, he couldn't meet with top military leaders in a top security facility because he didn't yet have a security clearance. >> i'm a member of the intel committee. i'm on the armed services committee and i can't meet in the skiff to conduct essential business. my point is we have
