. ****** 19-year-old brock turner entered a plea of not guilty to 5 felony counts today. police say other students told investigators that they saw turner on top of the woman outside a fraternity january 18th - where both had been at a party. the woman is not a stanford student. the witnesses restrained turner until police arrived. prosecutors say they're heroes who did the right thing. turner is free on bail and voluntarily left stanford to return home to ohio. the court is requiring him to stay at least 100 yards away from his alleged victim. this story has already attracted local and national media attention, but questions are being raised as to whether the rape charges against brock turner are merited. kron 4's charles clifford talked with a prominent local defense attorney who says the facts are not all in. nats in the criminal complaint against brock turner, he 's charged with 5 felony counts, counts one and two are for rape. the two witnesses to the alleged assault say they saw turner on top of the unconscious victim performing a sexual act.. specifically thrusting

they take brock's concerns seriously. brock saying he's returning to the priority of the board. there is without question a serious battle taking place right now over who will hold the backstage power and influence in clinton's likely presidential campaign. it's a fight that clinton whose campaign was beset by infighting and backstabbing. the core issue appears to be a struggle for power between former strategist for president obama who moved into the clinton orbit, including jim mesina, and was a president's 2012 campaign manager. and longtime clinton allies, including brock, who reportedly feared being pushed aside. the battle is fierce. in the "times" yesterday, one mesina ally described brock on the record as, quote, a cancer who is unwilling to do what's best for clinton and the nation. he added, if you care about your party and your country, you just do what you're asked. if you care about yourself, you take your toys and go home. joining me is someone who has been all over the story, political reporter for "the new york times." first of all, what is going on? so is this a

. >> and i'm sam brock. we do have developing news to tell you about this morning. police searching for the person who opened fire on a busy san jose restaurant. a woman who was eating inside was shot in the neck. >> kris sanchez live at police headquarters in san jose with the latest. good morning. >> reporter: good morning, laura. good morning, sam. police say that they don't have a suspect description to release just yet, but the woman who was shot in the neck last night was just in the wrong place at the wrong time. and that wrong place was the may hong restaurant at center and tully road in san jose's little saigon neighborhood. police say the woman was having dinner just before 9:00 when someone took aim at the restaurant from the parking lot, though not directly at the woman. >> the restaurant had curtains on it. we believe that the shooter was possibly shooting at the restaurant, but didn't really have a target in mind. one of the rounds struck a patron while she was eating. >> reporter: that woman was struck in the neck. she was transported to the hospital
