tom broderick could spend life in prison. sharon smith is on the case how is this jury selection going? >> well, paul, several potential jurors said they feel uncomfortable it seems unbalanced in the courtroom. you can tell the prosecutors are trying their best to choose the right people. and as for broderick he says he does not know what he is doing when it comes to choosing the jurors who could decide his fate. in the jury box was a barber, retiree, mothers and fathers some with young childrenment they will hear graphic evidence how this little girl died who barely got to experience life. police say she had broken bones and swollen brain tissue and signs of abusech those chosen to try to defend himself. the stop start delay and the stall of the past four years is over after one last and ironic attempt. todd broderick is representing himself. police say his daughter had broken bones, swollen brain tissue and repeated signs of abuse and allegedly all at the hands of her dad. pamela escobar was in that courtroom as the jury selection was underway. what did the juror say that caused the mistrial. >> maureen, the woman told the prosecutor she was looking at the newspaper and saw a picture of todd broderick and he claimed that that is the guy that robbed his house. now, the lawyer who is helping broderick said that she made a false statement and she said it the todd broderick came to court with the intention to select jurors. and several jurors have been dismissed for cause saying they could not look at photos involving child abuse. the woman's statement about the robbery caused the judge to excuse the jury pool. and the prosecutor said there was no way to cure what happened or what the jurors heard and the judge returned and said he would be granting a motion that to have a bench trial meaning a judge will hear the case not a
