that same suspect came back this week and somehow got into the bronxville school here during school hours. cbs 2 news obtained this image of a man identified by police as frederick nelson walking in a school hallway on wednesday just before an iphone was stolen from an office. harold clark has two kids who attend and was not happy to hear a felon was able to walk into a building full of students at 1:00 p.m. >> they are really good about the school security but i'm stunned he got in that easily. >> turns out nelson is being charged with shoplifting a chicken and iced tea from a grocery store across the street from the church and the reason he was in prison the past five years for a burglary on campus caught on surveillance cameras. >> we reached out to the bronxville school superintendant but have not heard back yet. >>> new york city's aging transit system is getting modern high-tech upgrades. governor couple o announced getting wifi and cell phone service. 1500 buses will have wifi hot spots and charging stations by 2018 and charging ports will also be installed on subways by next year.

career criminal is under arrest charged with stealing thousands of dollars in donations from a bronxville church on new year's eve. cbs 2's brian conybeare out of prison a day before the crime. >> reporter: caught on camera inside a catholic church in bronxville. mr ist say frederick nelson is the man with the -- police say frederick nelson is the man with the black eye glances who stole $2,000 during mass on new year's eve. >> mr. nelson has a lengthy criminal history just completed a four-year sentence on our concordia college case. >> reporter: bronxville police say nelson just got out of prison on december 30th for a burglary on a lutheran college. he went to a parole meeting the next morning and went to st. joseph's roman catholic church on cedar street. >> we see criminals release and repeat their crimes often, but for it to be within 24 hours -- >> reporter: surveillance video was watching as he allegedly waited for the collection baskets to be passed and snuck into a room behind the altar taking off with a locked bank deposit bag while parishioners were still praying. police in bronxville say the man walked into st. joseph's church on cedar street and walks into a room where he took the holiday mass donation bag. >>> a man convicted for a deadly triple murder in a newark schoolyard wants a new trial. prosecutors say rodolpho and five other men attacked a group of friends in a schoolyard in 2007. the victims were robbed, assaulted and three of the four were killed. according to a public report, he says that he and one codefendant were poorly represented by their attorney, a judge has scheduled a hearing next month for the two to testify. >>> the chick-fil-a restaurant in midtown is back open after it voluntarily closed its health department violations. a fast food restaurant at 37th 37th and 6th avenue, seemed to be doing some business today. it closed for six days after it received a c grade from city health inspectors. the company says workers performed maintenance and facilities updates during the six days. the place was reinspected today and now has a grade ending report card hanging in the wi
