in a statement brooke jenkins writes in part, we have been prepared to take this case to trial but the speed at which this case and many others moves through the criminal justice system is almost entirely controlled by the defense. but it's not just the victims of crime who are raising concerns about delays in trials here at the san francisco hall of justice. in fact, this is a separate rally that's being held here by the public defender's office raising the same concern. according to the public defender's office there are currently 1,160 criminal trials that are overdue. 211 are felony cases. the public defender says san francisco has the biggest backlog of any county in the state. at their rally, i ask the one of the deputy public defenders did they purposefully delay cases as part of a strategy, which adds to the backlog? >> i don't believe that's part of any strategy because in all these cases, as i said, it's important to get out to trial in order to resolve the case. >> reporter: the public defender's office suggests retired judges could be brought in to help get through the back
