broward county has a long history of electoral problems. me refresh your memory, in 2000 they contributed to the florida recount mayhem. two years later primary election in the county was a disaster. with broken voting machines. uncounted ballots. no show poll workers. 2003 they get their act together? no. more than 17,000 mail-in votes were returned as undeliverable. in 2004, county officials grossly mishandled absentee ballots keeping thousands from reaching voters in time. it's only gotten worse. more than a decade later. in 2016, the county was sued once again for mishandling absentee ballots and was also caught illegally destroying ballots even as the lawsuit over primary outcome was pending. the woman responsible for that is still in charge of county broward's votes today and that is mind-boggling. yesterday on this program, marco rubio denounced the process for violating florida's election laws. today president trump joined in on the attack. >> if you look at broward county, they have had a horrible history. if you look at the person

broward county thinks they met that deadline, 99.97% of ballots counted. the real question is, is that also true for palm beach county. as soon as i refresh my phone, palm beach county was the seconds of those two counties that the rick scott campaign was looking into as well as the nelson campaign. nelson campaign thinks that's a place they can pick up more votes and cured is how we talk about these provisional ballots. rick scott did sue palm beach county in addition to broward county for the supervisors to tell them how many votes were left to count. we don't know those numbers yet. the scott campaign did not get those numbers out of that lawsuit despite the fact that a judge did compel them to give them over. we're waiting for the legal side of it and for what happens on the secretary of state side of it over here in tallahassee. >> you can pick up your phone and start refreshing. see what you find out since the last two minutes. steve, let's say there is a statewide recap, how long is that process? what happens? >> reporter: its actually prescribed in

the election supervisor in broward county.ou may know about brenda because in 2016 a judge called her out for destroying ballots that benefited her friend debbie wasserman-schultz. so election night broward reports thousands of votes, and now there are reportedly thousands more votes. you are kidding, right? a primer. every county is supposed to hand in all early voting and absentee balance lots within 30 minutes of the polls closing. most of kansas city already count those ballots before election night. but now in a lawsuit brought against miss snipes, governor scott argues miss snipes is refusing to cooperate. the court ordered miss snipes to turn over record detailing how she counts ballots. snipes is refusing to turn over the record, saying it's inappropriate for a court into the screen this time simply because scott wants the counting process sped up. what is even more outrageous is after snipes destroyed ballots illegally in the 2016 election. her premature destruction of the ballots in a pending lawsuit was described as

, they complied with the law, including every county in the panhandle that was absolutely ravaged by hurricane michael 27 days prior to the election. broward, palm beach county, totally ignored the law. broke the law. four days, broward county officials continued to tally literally tens and thousands of votes in violation of state law. it appears yet again we have one system of justice and elections for democrats and another for the rest of us. the supervisor of elections in broward county, a woman by the name of brenda snipes, would not even tell state officials where these mysterious votes were coming from. where the votes have been. how many votes were left to be counted. again, a violation of law. there was no updating of votes every 45 minutes. again, violating the law. this morning, multiple boxes full of sample and provisional ballots left behind in some rental car, were actually discovered by an avis employee at fort lauderdale airport. this is insanity. we send election observers to other countries. we need them here. on friday, florida congressman matt gate literally blocked from observing a location where ballots were being load

let's go to broward county, florida. oh, actually, we're not going to check in there, but there are a lot of folks who have turned out in front of offices there who are expressing their concern about how all of this is going, now that the deadline has been reached. joining me right now to talk about all of this, the senior political reporter for politico in florida and larry noble, former general counsel for the federal election commission. all right. good to see you both. larry, you know, let's begin with you because, you know, a lot of folks are feeling like this is reminiscent of what happened in 2000. in florida on the whole presidential debacle race of 2000. there are similarities. now protesters. people who are overtly expressing their real concern here. but very much unlike that, this is an issue of counting all the ballots in the first place. now that this deadline has been met, is it likely that all of those count yips will have been able to deliver their results? >> well, i hope so. there are a number of things

in fact, you had people there in advance of the voting in broward county. the democrat side, rick scott and senator nelson's side, agreed to this remedy. fair points? >> that's fair point, but chris, you know, the real problem in broward county here is that the county election supervisor, brenda snipes, has not complied with the law. we have these laws in place to prevent fraud. when you don't comply with the law, we can't be certain there is no fraud. >> she wasn't complying then the judge told her she had to. she missed the initial deadline to do so last friday at 7:00 but then comply. you looked at it, it actually -- >> wait a minute, chris. wait a minute, chris. tuesday night, she's supposed to issue a count of how many votes she has left to count. >> right. >> she can still -- by the way, many other states you have to actually shave those early vote already counted by the time the election ends at 8:00. she merely has to tell us how many she had. >> right. >> the numbers she gave us she did not abide by. she continued to find 70,000 votes over the next

heather: tell us about your personal experience dealing with broward county specifically?sure, i ran for congress in democratic with debbie wasserman schultz, i had to sue brenda snipes the supervisor of election, a close ally of debbie wasserman schultz, they campaigned together just a couple of weeks ago and i sued, we won, we showed that she destroyed the ballots, that's violations of federal and criminal statutes, some are felonies, she lied to the court and really conspired with her own staff to commit the crimes. heather: so hearing you say that, this was 2016, she violated numb race state -- numerous federal states and statutes, why is she still in charge? >> that's a great question and i called on governor scott many months ago to fire her to conduct a criminal investigation and not just governor scott, reached out to florida attorney general, florida department of law enforcement, the u.s. attorney could not be bothered, these are federal offenses as well and i warned at the time if they didn't prosecute her or remove her from office she would be a walking flown,

steve: right. >> our county was fine. always browardts run the show. they better get their ability together. steve: thursday at 3:00. palm beach county, just south of you, has already said we're not going to make it we have old equipment. as people look in, should they feel confident that the votes are being counted accurately? >> no. absolutely not. they have already ignored. let's talk about facts. this is not hyperbole, these are facts. deadeadlines were missed one two things one like a total vet count. how many total votes are out there, brenda snipes? well, we don't know. secondly, they were supposed to post the totals for the mail voting. early voting 30 minutes after the polls closed and they didn't do it. those are facts. i have no confidence. brenda snipes should be removed from office and the secretary of state should take over. ainsley: are folks saying down there. rick scott had an opportunity to remove her after 2,000 and he didn't do it. are people upset with him. >> ainsley, people are on fire down here. genuinely upset.
