news 4's brynn gingras is outside lincoln hospital in the melrose section of the bronx tonight with more. brynn. >> reporter: and rob, that patient's name is marvin montgomery. he used to spend a lot of time around here, around lincoln hospital, which we now know is one of the five places that tested positive for legionella in the cooling towers. now he's in a different hospital, fighting for his life. and he says the city is to blame for his diagnosis. he's a 36-year-old father of one. right now marvin montgomery is focused on staying alive. >> you know, it's a step up from not living, but he's in very bad shape. >> reporter: his lawyer tells news 4, montgomery is on dialysis and can barely walk. having not been a heavy smoker, montgomery can only guess he's contracted legionnaires' disease from here, the cooling towers at lincoln hospital, which tested positive for the bacteria last week. >> where the disease harms sick and infirm people, the hospital had a special duty, in my opinion, to make sure that this bacteria wasn't present, they did not live up to that standard. >> reporter: s

news 4's brynn gingras has more. >> reporter: these are pictures of animals removed from a property in oes ld west bury. rib cages showing. authorities say they were mall neuro -- mal js nourished and mistreated. the owner of the property was charged with many counts of animal neglect. on the driveway it says, smile, you're on camera. it was neighbors actually watching him, seeing this mistreatment of the animals and being vocal about it. that's what may have helped lead to his arrest. >> they were out in the loose, the horses, no blank ets on them. no place to get shelter. this winter was a rough winter. there was a lot of snow. there were times you could just see that they were just standing still and shivering. >> reporter: david lives down the street. some of his neighbors also complained about the animals breaking loose. just the messiness of the property causing problems. >> one of the gentleman grows his own fruits and vegetables. he says the amount of vermin that came across, he sees them. he has special traps but he was unhappy that the animals looked so sick. >> reporter: whe

brynn gingras is in east new york where nine people were shot this weekend. when people hear statistics like that, brynn, they start thinking, what's happening. >> reporter: exactly, michael. it's a sobering scene outside brooklyn borough hall. it's needed to get the conversation going about stopping all of this violence. some of it happening right here in the 75 precinct. east new york is where i am this morning. let's look at this surveillance video. this shows some of that violence very clearly. it happens moments -- police say it happened in moments. two men gunned down nine people at a house party that happened early on sunday morning. but take a look at these numbers from the weekend's violence. seven shootings, three people killed. 16 others injured. nine of them from that house party alone. the mayor's office is taking this very seriously. but the community wants more. >> we're tired of standing here saying to the city do something. you got elected to be a mayor of the city. you now have to step up and do your job. >> reporter: now, this is something

. >> news 4's brynn gingras is at the scene with late details. brynn? >> reporter: david and shiba, a lot of damage happened on this sidewalk, as well. let me show it to you. this is a parking meter mowed down by the car, and also this rail here in front of the post office. as you guys said, two young girls were standing on this sidewalk, and they were certainly hurt with this. and here's what yonkers police tell us happened. one car rear-ended another here on main street. it appears the driver of the car maybe panicked and hit the gas instead of the brake, and that car jumped the sidewalk where the two young girls were standing and hit. they're both under the age of 10, according to police. and paramedics rushed them to the hospital. the good news here, both are expected to be okay. but had serious injuries. people who witnessed this crash said they tried to help those girls. >> the two girls walking past the post office and he hit them. the two little girls -- there was so much excitement, people were screaming and running to help the girls. >> report

brynn gingras has more. >> reporter: dive teams entered the waters off the coast of sandy hook, just underneath the surface in the channel, authorities believe they found the el heavia. a 40-foot fishing trawler that capsized. joe managed the market where the boat docked. >> i was on my way home when i got a phone call one of our boats went down. and i said none of our boats are out. and then somebody else suggested to me that maybe the el jeffe was out and so i turned around and came back and sure enough it was out. >> reporter: brandon identified the boat's captain as tom anderson. among fishermen who have worked this sea their entire lives, anderson was considered a rookie. >> he was learning as he went. he would go crabbing in the wintertime, he would go gill netting in the summertime and come pot fishing and lobster pot fishing. but other than that, he was just -- it was all a new experience for tom. >> reporter: witnesses say the boat took on water tuesday afternoon and went under. it took rescue teams nearly a day to find the sunken vessel while bri like this was located in th

"today in new york's" brynn gingras is on dwight street where, brynn, we understand police have blocked off part of the neighborhood? >> reporter: that's right, michael. now we know that detectives are looking for two people involved in this driveby shooting that happenen around 11:00 last night. dwight street. we know from authorities that they fired five shots that hit five people. houses. earlier this morning, we saw one victim with wounds to her had shin heading over after being discharged from the hospital. police say the gunman drove by around 11:00. fired out the window on dwight street. people were shot on the leg, the torso. one person has more serious injuries. that person was shot to the neck. so many shots were fired, actually one resident told us they thought it was fireworks. >> and i suspected it was just firecrackers which we hear a lot around here. then i saw ambulances coming down and sirens, and i poked my head out and saw cop cars showing up. >> reporter: certainly concerned about the gun violence happening in the neighborhood here and brooklyn and around the city. a

brynn gingras. >> reporter: this is the first time cdc officials have been here on the ground getting filled in on this legionnaires' outbreak. within the next half an hour or so we should also be filled in on exactly what they're their conversations entailed. right now, the state is saying it will foot the bill for towers. and a spokesperson for governor cuomo told me heah officials from other areas around the state will be conferencing in on this meeting to learn how to combat any small signs of legionnaires' that may pop up in their individual communities. what also is popping up today, though, the first lawsuit against the city from this outbreak. taeake a look at this man. this is marvin montgomery. he used to spend a lot of time ound lincoln h pital and now he's in arlem hospital fighting legionnaires'. his lawyer filed a claim, accusing the city of dragging their feet on this, a disease which he says is completely preventable. >> i think it's terrle. they moved very slowly. they weren't proactive in the beginning. they weren't proactive before, you know, before this outbreak. w

"today in new york's" brynn gingras joins us from sandy hook with what we know this morning. brynn, i know you're trying to figure out what's going on with this boat and what they're looking for. >> reporter: michael, there's so many questions that remain. one of them, did a boat actually sink. in a few hours, authorities are going to be back out here with divers using sonar as well to try to locate really anything at this point. and the coast guard is saying it really can't confirm this morning if a boat sank. reports are, though, that a 40-foot fishing trawler went under around 4:, tuesday afternoon. itst's unclear if anyone was on board ond who it belonged to. the sheriff's department tweeted a picture of possible debris in the debris field. that's the only glimmer of evidence that the authorities have seen. those who know the area well understand the difficulties that rescue workers face. >> right there, it goes from like 4 feet to 60 feet in a matter of a few feet. >> reporter: yeah. you can imagine how fast that water is moving. that is something that these rescue worker
