brynn gingras is live outside the courthouse. donald trump was still talking as he walked in to court today. what did he say? does it cross any of those lines? >> reporter: he didn't, but he did still express frustration. he expressed frustration once again which he has done multiple times before about not having a jury trial in this civil trial. it is important fact to note h here. this doesn't allow for a jury trial. so that is why the judge in this case is going to be issuing the final punishment or the penalties or whatever -- basically the outcome of this case. so important to note that even though he continues to express frustration outside the courtroom and even inside the courtroom as the court proceedings are continuing to go on, and we're getting updates from our courtroom reporters, and this might be more double down frustration from trump after that gag order that you just mentioned about. and this gag order was issued yesterday by the judge after truth social post that trump put on his truth social, it shows a pictur

brynn gingras is standing by. and brynn, the a.g.'s office is laying out what they hope the judge will do here. >> yeah, it took a little less than an hour to do so. i wanted to go through what is going on now, kate, and then i will talk about that. and right now, we are hearing from trump's attorneys, and their sides of the opening statements saying here, that there were no attempts to defraud. there were no unjust profits made, and there are no victims in this case. essentially saying that donald trump built a huge empire, and he did it all rightly so. essentially saying that he did not do anything that is against any rules, and he performed all of the right maneuvers in order to make money, and so we are going to have the crux of the case k right. this is how they will defend their client, and we know that donald trump is there at the table with his attorneys weighing in on what they are saying as they give these opening statement, and you are right, we have heard in an hour or so less than the state's attorneys that they did defra

cnn's brynn gingras is outside the courthouse this morning with the very latest. brynn. >> reporter: yeah, john, as always, the former president before he walked into the courtroom for the start of day three, he did make some comments. as you just noted, he was a little more careful this time, all because of the gag order that was issued by the judge here after that personal attack, the judge called it, from that truth social post that donald trump made yesterday. it was a picture of the judge's clerk, identifiable of who it was, in a picture with senate majority leader chuck schumer saying without any evidence that she is schumer's girlfriend. that was really a bridge just too far for this judge. he issued this rebuke against not only the defense but everybody involved in this case to not issue anything publicly about anyone on his staff, whether it be, you know, in comments or on any social media saying personal attacks of any member of my court staff are unacceptable, inappropriate, and i will not tolerate them, and he said there will be strict sanctions if tho

. >> cnn's brynn gingras is outside the courthouse. also with us, cnn chief law enforcement and intelligence analyst john miller and cnn legal analyst jennifer rogers. great to have all of you. brynn, let's start first with you. we've heard some well worn trump rhetoric going back to his playbook again and again. but how are things shaping up inside that courtroom? >> reporter: jessica, pretty much any time there's a break, he comes out and talks to the cameras, very much political moves by the former president. i'm getting realtime updates from my colleagues in the courtroom. they say right now the first witness is on the stand, that's donald bender, he was the former accountant for trump and trump org and right now he's testifying to the fact that he compiled financial statements for the trumps and trump's orgs, but didn't really do the analytics of it. that speaks a little bit to how his testimony is going to proceed from here on. before that with opening statements, and, of course, that's the crux of any case. let me get to that. in

brynn gingras reports from new york. >> reporter: gag order issued by this judge against the defendants in this case all because of a truth social post by the former president. it was a picture of the judge's clerk with senate majority leader chuck schumer and in that post basically claiming without evidence that she is schumer's girlfriend. this clearly crossed the line for the judge when court resumed in the afternoon, he discussed the matter saying that there was disparaging and untrue and personally identifiable picture that was posted of a member of his staff. he ordered that it be deleted. but he said that it was already sent to millions of people. and he said this, quote, personal attacks of any member of my court staff are unacceptable and inappropriate and i will not tolerate them. and after that, he said that none of the defendants could speak publicly about anyone on his staff. so remember, this is the same judge who will be calling all the shots determining damages in this trial and the president clearly going too far on this one. a gag order now issued against him on just d

brynn gingras is there for us. >> and the judge is speaking, and there are two cameras outside of the courtroom, and it is difficult to know the tone. but we will tell you that letitia james came in and she didn't make any comments to anyone, but there is someone who thanked out to say go get him and thank you, and a big thumbs up and a smile. and the reporters inside of the courtroom says that the mood is friendly, and there is attorneys talking with each other, and attorneys hugging the other side, and the attorney general's side with the defense and so it is a different mood right now than what we were seeing with the tense environment for day one. when the court is started today, we expect the former accountant donald bender to get in and the attorneys to go through the nitty-gritty of the financial statements and how the valuations were determined in the trump properties, and of course, the defense is fighting that there was no fraud here and no intent, and there are no victims in this case. as far as the former president is concernedsh it is unclear how long he plans on staying

but we start in, in with cnn's brynn gingras outside of the courthouse in new york city. what is happening in the courtroom right now? >> reporter: yeah, jake, well the state's first witness is still on the stand. dond bender was trump's and trump organization former accountant. he's getting questioned about the state about particular financial statements which come into question for this entire trial. but let's begin with the opening statements which were earlier today on the state's side, they basically presented a case to judge that trump and his sons and trump org, conspired together to commit years of fraud, inflating assets to get better interest rates, better business loans and essentially said they knew that they were doing, and they're going to call a bunch of witnesses to the stand. one of them you're very familiar with, michael cohen. he will be called to the stand to show basically -- believe that they inflated these assets. if you remember, this whole case was brought based on michael cohen's testimony to congress where he said, just that. now on the defense

brynn gingras is on this. brynn, for those who thought that we had reached the bottom, apparently there is no bottom. tell us what the social media post was and what happened today. >> reporter: not so unfamiliar territory when it comes to the former president, right, jake? this was a truth social post that the former president put up on tuesday, today, showing a picture of the judge in this case and his clerk in a photo with senate majority leader chuck schumer claiming that she is his girlfriend. there is no connection to our knowledge of any relationship beyond this photo. that's still yet to be determined. so he put it up there basically with no truth behind this photo. that led to the court after lunch, starting later today, about 45 minutes later. the judge took to the bench and essentially issued a warning to a particular defendant -- didn't say trump by name, but said that tlafs disparaging untrue and personally identifiable post about a member of his staff. he ordered it be deleted. it was deleted. he

i want to go to brynn gingras, and you are there with a report on the whole setup of how donald trump just stood there waiting for everybody to get setup. clearly a political move. >> and choreographed and taking longer than when this court is to start at 10:00 a.m., and we will see what the judge has to say about that. and kara scannell and my other colleagues are there, and clearly not acknowledging letitia james, and not giving her eye contact or handshake or anything whatsoever. and then sat down with his two attorneys and keeping gaze largely down. so we are waiting to see how he acknowledges this judge, and again, someone he just politically attacked outside calling disparaging the judge just as he has done on the campaign trail for so long. so we will see how this all sort of plays out. again, as he is the reason that actually the court is beginning late, it seems at this point. we also should mention that we do expect him to testify. that is one of the reasons that he is inside of that courtroom. he wanted to defend his reputation as he has beeen saying. it may not be today or

we begin with cnn's brynn gingras who is outside the courthouse in downtown new york city. n, what are you hearing this morning before the case gets going? >> reporter: listen, guys, there is immense security here, immense press presence. you can't see what's to my left but what is to my left is a podium for new york attorney general letitia james. we are expecting her to make some comments before she heads into the courtroom which is going to be an interesting face-off when trump does arrive and as you just said sit in the courtroom for the opening statements for the civil trial as well. remember she is the one who brought this case against trump, his organization, his adult sons, asking for $250 million and other penalties for falsifying business records allegedly for many of his fortune, his mass fortune, his business empire. it's going to be an interesting trial because he is also on her list of witnesses. he's on the defense side as well, but it's possible, and we are told he's eager to testify in his own defense, although we don't expect that to happen today. what's al

brynn gingras is live outside the courthouse. what's happening so far today? >> reporter: yeah, so we just wrapped up a short break in testimony. when everyone returned back into the courtroom including the former president, the judge actually warn ed the defense tht he needs to start in a timely fashion. apaparently, there was people that were late inside that courtroom, and basically, made they can them acknowledge the fact that they will be on time. this is as the former president took to the microphone during that short break making comments, disparaging about this trial in general, but also saying that he will testify in this trial. now that's not a huge surprise. we have heard he's eager to do so, but this maybe the first time we heard it from his own mouth. it's important to note that reporters say the former president and his son, they are extremely engaged in this testimony that is continuing with their former accountant, donald bender. they are looking through the documents up on screens. they are discussing issues with their attorneys, as they conti
