secretary burrwell welcome.day marks your first official appearance but i know this is not your first time in this room our roundtables last year and we very much appreciate that participation. your testimony does come at a pivotal point to next week's supreme court oral arguments. we look forward to hearing the administration's perspective on the many important issues facing the american people. you have said that transparency ownership and accountability are important values for the department to demonstrate which we certainly welcome. in that spirit we look forward to gaining straight forward answers here today about implementation of the president's healthcare law. there has been quite a few red flags raised in recent weeks on the continued struggles to implement key pieces of that health law. just in the last week, 800,000 households learned that key tax forms sent out by the administration contained major errors. those americans were asked to delay tax filing, therefore also delaying their refunds. a recen

burrwell case. their intention is simply this -- that it was the intent of congress to only provide insurance subsidies to states that had state exchanges and not federal exchanges. i haven't found a single senator or representative who voted for that law who says that it was their intent to punish states that didn't establish state exchanges by withholding subsidies from millions of americans, and in fact there is no way to plainly read the statute without coming to the conclusion that subsidies were not just intended but written into the law to go to every single state no matter what kind of exchange they decided to establish. the law says that because it specifically states that states that don't choose to set up their own exchange will have a federal exchange take the place of that state exchange. but the totality of the law is clear as well. if the federal government had intended to set up exchanges -- give subsidies only to states that had state exchanges they would have also made the insuranc

these are the goals that secretary burrwell announced this past january 26.k blue circle here on this page. so the dark blue circle is percentage of medicare fee-for-service payments and alternative payment models. in 2011 there were zero. in 2014 at the end of 2014 about 20% of the $362 billion of medicare fee-for-service payments excluding medicare advantage but numbers are similar. about 20% were alternative payment models. the goal is that by the end of 2016 30% of medicare fee-for-service payments will be in new models that work and 50% by the end of 2018. this is the first time in the history of the medicare program that we have set broad national goals. and what's really critical to understand that it is not just a medicare project. this past wednesday at the white house you may have seen that president obama kicked off something called health care learning and action network where we have convened commercial payers, state medicaid organizations and purchasers to join us in matching or exceeding these national goals. and for the last five years cms thr

i've ever done that anybody could ever do because the law is so clearly on our side in king versus burrwell. as you probably know the relevant provision says that the zip for exchanges are available on, quote, exchanges established by the state under section 1311. the obama irs reading that language says that means, of course, they're available on exchanges established by hhs under section 1321. so the issue is whether or not an hhs exchange under 1321 is a state established exchange under 1311. this is not a complicated question for the -- at least for the nonlegal mind. this would be relatively straightforward. and i mean that. if this was a mortgage deduction case. if this was -- no judge would say, what are you talking about? it's only because we're in this political maelstrom involving the affordable care act that people are taking this argument seriously. i'm not going to bore you with walking through all the various statutory nuances of this. but i will give you the basic pitch on the other side is, oh, you're just ripping these words out of context. and what an extraordinarily odd p
