and byron york, "washington examiner" and are both fox news contributors and followed this since day. byron, let me start with you. your initial reaction when you read through the documents today? >> it clears up a couple of the mysteries. we had seen in the court papers released not long ago about august 22 report on this. we didn't know what it was. now it turns out that peter strozk, the f.b.i. agent who interviewed flynn in january of 2017 was interviewed himself by the f.b.i. in august and he recalled some of those detailed. by the way, the original report that the f.b.i. agents wrote about the interview on january 24, 2017, the original report on that was not released today. it's possible that the prosecutors gave it to the judge under seal. probably a gad idea if they did -- good idea if they did. but we didn't get to see it. >> martha: what was not revealed as you point out is exactly what was said between the agents and michael flynn at the white house so we still don't have a record of that, jonathan. >> that is right. the record we have only gets worse. the clip you played

let's bring in our panel, byron york is the chief political correspondent of the "washington examiner." i may interrupt you if i see senator schumer and the minority leader nancy pelosi. your thoughts as this developed today include the president -- it happened fast. >> we saw a whole bunch of stories that he was caving and he was going to agree to this, we had a lot of criticism of him by rush limbaugh and ann coulter, paul ryan and kevin mccarthy go over to the white house and he is not going to sign this bill that the senate has passed. one interesting thing here, in this procedural vote that he was reporting about he said they had 400 votes which means that republicans have gotten a lot of their members back in washington. i think they had 217 votes in that boat and they believe they can pass this. they were quite affected by these predictions from nancy pelosi and you just heard chuck schumer predicting it as well, they were affected by these democratic projections they didn't have the votes in the house and i think they are trying to say we do. >> bret: here is schumer earlier a

byron york wrote an interesting piece today, i want to quote from it, it is titled, he says nothing aboutollusion allegation. it says mueller scrutinize everything he told congress. if mueller had evidence of cohen's definitive denial of the prague story, it seems reasonable to conclude that mueller would have charged cohen for it. in the charges against cohen, mueller said absolutely nothing about prague. remember the prague meeting? that was supposed to be another nail in the coffin of donald trump, and showing real collusion. no mention, nothing. >> but it is so important to understand, you have to look first at the statute books. you can't look to these bag, brought statute like obstruction of justice or conspiracy, you have to find specific, mens rea, act is real, results. it seems to me, the mueller founds, in their haste to try to find anything on this before are forgetting basic liberties, and that is the ex post facto claus clause, a specific, criminal act that is already prohibited by the statute. then you have to prove it beyond a reasonable doubt. so far away from that. >> lau

byron york, congress has been out for a couple of days. >> they're in the middle of a six-day weekend. they've given themselves a six-day weekend and they'll come back to try to figure out the rest of the spending bills. look, the wall along the u.s./mexico border was president trump's premier campaign promise. we heard him over and over and over promise to build a wall. and he has had chances in his first two years in office, very specifically this year in march passing a big spending bill. there were negotiations. it looked like it might be possible to get $25 billion, the whole amount, to build the wall in exchange for giving amnesty to all of the daca recipients. as it turned out the white house added on extra demands, the whole thing fell apart and then in september another big spending bill was passed and republicans urged the president not to go ahead with wall funding or push for wall funding then because they worried it might hurt their chances in the mid-terms. they go ahead and lose anyway. so now here we are. and in the house, republicans are lame ducks and it seems very u
