chase cain joins us live at children's hospital in oakland with reaction from family members. good morning. >> reporter: good morning. it looks like we are headed back to the courtroom again, a judge is likely going to have to get involved in this, even the family's request to move jahi mcmath elsewhere is not coming uncontested from the hospital because the hospital continues to lean on the judge's ruling and the finding of doctors that jahi is legally dead. the 13-year-old was declared brain dead on december 12 after undergoing a tonsillectomy here

chase cain live at the scene.t appears crews are starting to wrap things up. >> reporter: yeah, the police midwest a bit ago opening up the roads in the area. firefighters left a little while ago as the fire is really just sort of wrapping up. the last few smoldering bits of the fire are out now. you mentioned that we are across from candlestick park. that is sort of ironic because this trash pile was the size of a football field, 100 yards long, eight feet deep so that has a thick pile of trash. it was mostly scrap building materials that caught on fire, pieces of lumber and sheetrock. because it was packed so tightly in this warehouse it made it difficult for san francisco firefighters to really get in there and get this fire out. that is why it burned for nearly nine hours here at this facility off of tunnel avenue. firefighters say that they don't believe there was anything especially dangerous with the smoke so did not order evacuations but the smoke in the warehouse did get thick so they had to cycle their f

chase cain joins us in san francisco with an update on the investigation. good morning. >> reporter: good morning guys. last night this turned into a three-alarm fire. there were at one point 115 firefighters out here at the scene of this fire. some of them are still out here this morning investigating the fire. there was such a large response because these old victorian homes are as you can see are so close together and of course made of wood so they can burn quickly and firefighters wanted to keep the flames from spreading. there was damage to the home at 620 baker. the house that first caught fire was 618 baker t fire broke out before 9:00 last night. by the time firefighters got here there were smoke and flames pouring out of the back of the house. it was a difficult fire for them to fight because it started, they believe, on the third floor of this four-story victorian. once crews were able to get inside they found two older men near the front door. the men had very serious burns and appears they had been trying to get out of the house but were not abl

chase cain joins us live with new details on the disagreement and what's next. good morning. >> reporter: well, it appear this is will be headed to court. that is likely the next step as a judge will have to intervene because the family wants to move jahi mcmath out of children's hospital into a new facility. the hospital is not willing to perform a surgery that would be required to move the 13-year-old girl. 13-year-old jahi mcmath was declared brain dead on december 12 after a tonsillectomy here at children's hospital. this week on tuesday a judge declared that she was legal hi dead after hearing from several doctor who is examined the teenage girl. the judge did have an order in place which will expire monday afternoon, to keep her on a ventilator. before that happens, her family wants her out of children's hospital into a new facility but that will require a surgery to insert a feeding tube. >> children's will not assist in this, then we will seek to have a physician come in and do it. if children's tries to block that then we'll be back in court seeking to

chase cain joins us live in oakland with reaction from family members. good morning. >> reporter: good morning. it appears a judge will have to get involved in this dispute one more time because the family of jahi mcmath wants to move her to another facility and 3 have a facility that will accept her but the hospital continues to lean on the judge's ruling that the girl is legally dead. the 13-year-old was declared brain dead after undergo requesting a tonsillectomy here at children's hospital in oakland. on tuesday, a judge declared that jahi was legally dead after he reviewed the findings of several doctor who is examined the girl. the judge's order to keep her on a ventilator expires monday at 5:00. before that the family wants to move her to another facility to keep her on a ventilator. that will require surgery to insert a feeding tube. >> children's will not assist in this, then we will seek to have a physician come in and do it. if children's tries to block that we'll be back in court seeking to have what we call a writ of mandate to make them do
