i think supervisor campos' record is clear. he has been the vice chair of the transportation authority and he has also worked with numerous communities on transportation justice issues. i want to speak to another issue which is incredibly critical. going into the next year or so, mtc have been engaged in a critical issue called sb-375, which is literally going to impact and change the face of san francisco by trying to use regional planning to impose a density requirement on san francisco. i think these questions are incredibly critical for low income communities, particularly those who have reached transit corridors. district 9 is certainly a district where we have incredibly rich transit corridors, particularly around mission boulevard. i think it is incredibly critical for a supervisor who was in that district, which are going to be severely impacted by this regionalization of land use, to be on the metropolitan transportation commission, so i strongly support supervisor campus. thank you. supervisor kim: thank you, mr. youn

commissioner campos: ok. thank you. >> i might as well talk briefly about the authority's commitment to the project. $132 million is the current commitment. that is comprised of prop k funds, state traffic congestion relief funds. the prop k money is there. all that remains is the state funds that have not gone to the program. briefly, we have $19.7 million in local programs. there are some eligibility issues. there is a $30 million writ commitment. these programs are all available in 2012 and 2013. we will probably bring that action to you, hopefully next time. the very last part of this action is on page 55 and 56 of your memo. it has to do with reprogramming actions. this basically refers to deobligating funds. the first category that is affected is the muni funds. $18.7 million are being deallocated. this is possible through the common nation of $9 million in savings -- to the combination of $9 million in savings and also in she was lucky to get a $35 million grant from the federal government. that gives

supervisor campos: president chiu? supervisor chiu: could you tell us again, the hours that individual board members have -- they come out of the budget analysis? >> they come out of the performance -- what we are recommending to give flexibility to everyone is -- last year, we had two buckets. i believe we had 1000 hours for special requests and another 4500 hours for projects approved through a motion of the full board. what we would like to do for 2011 is combine those hours and maintain it at the 5500 hours but allow a little more flexibility, whether the request comes from an individual member or a motion. instead of having a restricted motion -- restricted number for an individual -- because we found we had to be very flexible last year -- is that each request would be limited to 150 hours. after that, you would either have to go before the board, which we had an example of that happening in 2010 -- supervisor chiu: i guess if you're saying last year was 1000 hours for specific legislative requests, another 4500

[applause] supervisor campos: a queue. one of the recurring themes we're hearing from the speakers -- thank you. one of the recurring themes we're hearing from the speakers is the the programs are literally saving lives. how do we deal with that as a city? last year, we added about about $1.7 million in violence prevention funding. there is a real danger that a lot of that will be eliminated t. how do we deal with that? what happens in our community? >> i am with the health department. i wanted to talk about the community-based organizations. we have several hundred organizations. it represents about half a billion dollars for the city. for the last two years, it has been bringing the organizations together to talk about how we can strengthen the partnership between the city and the community-based organizations. they provided great foundation for the community as a whole. the stronger the organizations are in being able to manage finances and programs with the city dollars, the better and stronger they are. this is an imp

supervisor campos. supervisor campos: i think this kind of discussion might be more appropriate perhaps in closed session to the extent that we're talking about legal positions that impact the city. but i do want to, for the record, point out what at least the case law, the two cases that i have read independently say about this. you have the embassy versus city of santa monica where the court basically says that in that case you had a situation where there was an agreement between the city and the developer, and this is whether the court said -- what the court said, nor are we proceeded by the city citation to other statutes which waiver is specificallyly probated and the city accompanying that argument it is not prohibited and thus allowed. as we've seen the ellis act provides a contractual waiver is unenforceable. i mean, that's that case. and then you have the palmer versus city of los angeles case and again, it goes back to the issue of whether or not there is a waiver here that can happen. and thi
