there we are breaking the news tonight. >> is likely something is in a candlestick park, someone being arrested or a fight. last year 199 people were arrested at 40 niner home games including the preseason. so what happens after that? how are these people being punished? these are the questions i had so we are doing some digging, acquiring paperwork that listed every person that was arrested a 40 niners game in 2012. what i found was, let's say a bit unsettling. that they prosecuted just 5% of those cases. that means that 95% of the time those in trouble got kicked out of the stadium and a property but nothing more. number showed that more than half of all arrests had to do with fans being drunk in public. the district attorney's office says oftentimes those folks are put in the van and left is so up and then let go. the district attorney makes the final call in these cases but he makes that decision based on what he is given. >>> and only 5% of arrests were prosecuted a year. it's very possible that they were prosecuted in other cities but not one out of 10 people were being prosecute
